Santander agreed to a $14 million class action lawsuit settlement to resolve claims it sent insufficient repossession notices to Pennsylvania borrowers.Â
The settlement benefits borrowers who entered into a retail installment sales contract with Santander Consumer USA for financing the purchase of a motor vehicle, and whose vehicles were repossessed by Santander after the lender sent a notice of repossession to a Pennsylvania address between June 30, 2014, and July 9, 2020.
According to the class action lawsuit, Santander failed to send the proper repossession notices to Pennsylvania borrowers before repossessing their vehicles. Plaintiffs in the case claim the insufficient notices violated the Pennsylvania Uniform Commercial Code and the Pennsylvania Motor Vehicle Sales Finance Act.
Santander is a lender for consumers, small businesses and communities.Â
Vehicle owners may be interested in products from Advance Auto Parts.
Santander hasn’t admitted any wrongdoing but agreed to a $14 million settlement to resolve the repossession class action lawsuit.
Under the terms of the Santander settlement, class members can receive a cash payment based on their account information. If additional funds remain in the settlement, up to three additional rounds of payments will be issued.
No payment estimates are available at this time.Â
The deadline for exclusion and objection is Sept. 22, 2023.
The final approval hearing for the settlement is scheduled for Oct. 17, 2023.
No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive a settlement payment.
