Norwood Clinic agreed to a $2.3 million data breach class action lawsuit settlement to resolve claims that it failed to protect patients from a 2022 cyber incident; class members must submit a claim form to benefit.

The settlement benefits individuals who received a data breach notification on or around March 8, 2022, informing them that their information may have been compromised in a Norwood Clinic data breach.

The Norwood Clinic cyber incident, announced in March 2022, allegedly compromised patient identifying information and private health data. Plaintiffs in the class action lawsuit claim Norwood Clinic could have prevented the data breach if it had implemented reasonable cybersecurity measures to protect patient information.

Norwood Clinic is a specialty healthcare clinic based in Birmingham, Alabama.

Norwood Clinic hasn’t admitted wrongdoing but agreed to pay $2.3 million to resolve the data breach class action lawsuit.

Under the terms of the settlement, class members can receive up to $1,625 for out-of-pocket data breach losses. This includes expenses such as documented bank fees, credit costs, communication charges, fraudulent charges, identity theft damages and up to 20 hours of lost time compensated at a rate of $25 per hour.

Class members can also receive free credit monitoring and identity theft services. These services include dark web scanning, identity theft insurance, real-time credit monitoring with all three bureaus and fraud resolution agent support. 

The deadline for exclusion and objection is Feb. 19, 2024.

The final approval hearing for the settlement is scheduled for April 22, 2024.

To receive a payment under the Norwood cyber incident settlement, class members must submit a valid claim form by March 20, 2024.
