North Carolina current and former tenants of The NRP Group have secured a $425,000 settlement which resolves allegations that the rental company illegally charged eviction fees to those who didn’t pay their rent in full by the 10th day of the month.
Class Members include those who resided in North Carolina Properties owned by The NRP Group LLC, NRP Management, NRP North Carolina, NRP Partners, NRP Alston Village (also known as Falls Ponte at the Park), or NRP Alston Management.
These tenants must have also either received a collection letter from the property owner between Sept. 6, 2014 and June 25, 2018, or who were charged and paid eviction fees. Eviction letters must have threatened a summary ejection lawsuit, eviction action, or notice to vacate, along with the threat of eviction fees if the Class Member failed to pay rent in full.
The North Carolina NRP Group eviction fees class action lawsuit contended that the property management company engaged in unfair debt collection practices. According to the complaint, NRP Management Group slammed tenants who didn’t pay their rent by the 10th of the month with filing fees, service fees, and attorneys’ fees. Together, said the plaintiff, the fees constituted “eviction fees.”
However, NRP Group would threaten tenants with eviction fees as early as the 5th of the month, if they had not paid their rent, alleged the complaint. According to the North Carolina NRP Group eviction fees class action settlement, the eviction fees became due for tenants even if they paid their rent by the 10th and no eviction proceedings were initiated.
The North Carolina NRP Group eviction fees class action lawsuit pointed out that the property management company had not incurred the fees it was charging tenants. Further, there was no guarantee that the fees would be awarded to NRP as a result of an eviction proceeding in court.
North Carolina NRP Group refused to admit any wrongdoing in the class action lawsuit, but agreed to pay $425,000 to settle the claims made against them.
Under the terms of the North Carolina NRP Group eviction fees class action settlement, those who received collection letters threatening the fee will be entitled to receive approximately $50 for each letter, up to $150. Class Members who actually paid the eviction fee are expected to receive $1,225.
To make a claim for collection letters, Class Members must submit a Claim Form. Class Members who paid eviction fees do not need to submit a Claim Form; however, if a Class Member who both paid an eviction fee and received a collection letter wants to make a claim for the letter, they must submit a Claim Form for the collection letter benefits.
Class Members who wish to exclude themselves or object to the North Carolina NRP Group eviction fees class action settlement must do so by Jan. 9, 2020.
Who’s Eligible
There are two Classes in this settlement:
“Collection Letter Class: All natural persons who (a) at any point between September 6, 2014 and June 25, 2018, (b) resided in any of the properties in North Carolina owned and/or managed by Defendants, and (c) received a letter that threatened that NRP would file a summary ejectment lawsuit, an eviction action, or notice to vacate the premises if the person failed to make a complete rental payment and that once the summary ejectment lawsuit was filed, the tenant would be charged Eviction Fees in order to dismiss the eviction action.”
“Eviction Fee Class: All natrual persons who (a) at any point between September 6, 2014 and June 25, 2018, (b) resided in any of the properties in North Carolina owned and/or managed by Defendants, and (c) were charged and (d) actually paid Eviction Fees.”
Potential Award
Up to $1,375.
- Collection Letter Class Members will receive approximately $50 for each letter, up to $150
- Eviction Fee Class Members will receive an estimated $1,225
Proof of Purchase
Collection Letter Class Members must provide their claim ID or the month and years that they received a collection letter to qualify for the maximum amount.
Eviction Fee Class Members will be automatically entered into the settlement.

Any recent updates?
Never received anything. I noticed though that another management company took over where I used to live at. It’s November now so I guess they found a way to screw me again.
My settlement was from the Durham, NC group against Falls Point apts(NRP Group).
I received payment for the class action suit by mail August 20, 2020!!
