Consumers can benefit from a Nevada Restaurant Services settlement if a 2021 data breach compromised their information.

The settlement benefits individuals who received a data breach notification from Nevada Restaurant Services informing them their information may have been impacted in a Jan. 16, 2021 data breach.

According to the class action lawsuit, Nevada Restaurant Services failed to implement reasonable cybersecurity measures that could have prevented the 2021 data breach, which allegedly compromised Social Security numbers, ID numbers, financial account numbers, health insurance information and other sensitive data.

Nevada Restaurant Services is the owner and operator of gambling parlors, hotel casinos and resorts in Nevada, including Dottyโ€™s.

NRS hasnโ€™t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the data breach class action lawsuit.

Under the terms of the Nevada Restaurant Services settlement, class members can receive up to $10,350 for data breach-related losses. Reimbursement covers $350 of ordinary losses, such as bank fees, communication charges, credit expenses, travel costs and lost time compensated at a rate of $35 per hour. Consumers can also claim up to $10,000 in extraordinary losses stemming from fraud or identity theft.

Class members who do not have documented losses to claim can instead receive an alternative cash payment of $50. These payments may be reduced on a pro rata basis if the amount of payments claimed exceeds $150,000.

The settlement also provides three years of credit monitoring and identity theft insurance.

The deadline for exclusion and objection is Aug. 19, 2024.

The final approval hearing for the settlement is scheduled for Nov. 7, 2024.

To receive Nevada Restaurant Services settlement benefits, class members must submit a valid claim form by Sept. 17, 2024.
