Nationstar agreed to a $5 million litigation settlement to resolve a class action lawsuit claiming the company sent incorrect automated clearing house, or ACH, entries to mortgage borrower bank accounts in April 2021.

The settlement benefits consumers whose mortgages were or are serviced by Nationstar and who were affected by the incorrect ACH debit and credit entries sent April 23, 2021.

In April 2021, mortgage borrowers with loans serviced by Nationstar allegedly experienced incorrect ACH debit and credit entries on their bank accounts. These inaccurate entries allegedly caused consumers to overpay on their mortgages and sustain other financial damages.

Nationstar, now known as Mr. Cooper, is a mortgage lender and servicer. ACI, another defendant in the case, is an ACH clearing company.

Nationstar and ACI haven’t admitted any wrongdoing but agreed to a $5 million mortgage borrower class action lawsuit settlement to resolve the ACH claims.

Under the terms of the ACH settlement, class members can receive a cash payment. The settlement guarantees payments of at least $100 for all class members but allows claimants to seek additional compensation for unreimbursed out-of-pocket expenses they sustained as a result of the ACH incident.

Class members whose overpayment was already reimbursed may have their payments reduced. The $100 payments may also be reduced depending on the number of approved claims.

In addition to providing cash payments, Nationstar and ACI agreed to forgive any entitlement they may have to recover from class members. This includes $2.86 million in overpayments and around $190,000 in damages.

ACI agreed to implement several business practices to prevent future ACH incidents. These changes are valued at $1 million.

The deadline for exclusion and objection is April 29, 2023.

The final approval hearing for the Nationstar mortgage borrower ACH settlement is scheduled for May 31, 2023.

In order to receive settlement benefits, class members must submit a valid claim form by Nov. 13, 2023.

    Crooks!
    When I fell behind with my mortgage,Nationstar started adding charges for monthly property inspections to my bill. IThe amount was $30 a month.. I
    asked Nationstar for a copy of the inspection report for which I I was paying. Their answer was that it was another party unrelated to nationstar who was requiring property inspections. Therefore, she further explained, I wasn’t entitled to a report. Naturally they refuse to give me the name of the third party. My stress level being high due to the stress of possible foreclosure ahead, I lost it. “Can you tell me why I never see an inspector or why no one knocks on my door to see if I am home”? I asked in a not at all calm voice. Nationstar tells me that they drive by my house and do the report that way just to make sure I’m still on the property. Really? I explained to her then that I’m not making the payments because I had both my wrists crushed and both arms had multiple breaks. I can’t, eat, take a bath, or open a door. Also, my ankles were sprained and I cannot walk. Because of these mishaps, I haven’t even gotten near a lawn mower or rake or broom. I had no one to help me, therefore, my house looked abandoned with the abundance of weeds and dead grass an empty flower beds. Finally I told her if anybody had driven by my house they would have knocked on the door or they would have immediately put me into foreclosure because they would have thought my property was abandoned.
    I caught up on my morgage inspire of their bogus fees.. Everytime I made an overpayment, instead of paying down principal as I requested. My extra payments were sapplied to these “property inspections” which totaled several hundred dollars. Finally paid those off a few months ago.
    This is one of several shady schemes I have witnessed from these crooks

    Mr Cooper took insurance check for payoff balance cashed check after they gave payoff amount then said it was not right then tried to refund insurance check and did not give deed to house

    NationStar AKA Mr. Cooper had continually put additional payments I made into some unknown account holding and not applying it to my mortgage. They are crooks and need to be shut down. I filed a complaint with BBB and Federal Trade Commission Consumer Protection and got no relief.

    This mortgage company is taking money from customers and still have a business license. I wish I could talk to someone about this. They have caused me and my husband some much stress, and my husband had a massive heart attack in 2020 and they tried to foreclose on our home. Also had someone taking pictures of our property and we had no clue about it

    there needs to be another class action against them for illegal foreclosure procedures as our servicer is Rightpath Servicing who told us we had to pay the lump sum after the covid forbearance ended even though Freddie Mac said it would be added to the end of the note. Then we receive letters from Mr. Cooper & Nationstar but if you ask Rightpath Serving, they will say they are not a part of Mr. Cooper or Nationstar so then how can Nationstar try to foreclose on our home?
