
Nations Direct Mortgage (NDM) has agreed to a class action lawsuit settlement to resolve claims that it failed to prevent a 2023 data breach that compromised sensitive consumer information.
The Nations Direct Mortgage settlement benefits individuals who live in the United States and who Nations Direct Mortgage notified that their private information was affected by the December 2023 data breach.
The Nations Direct Mortgage data breach settlement also benefits a subclass of California residents who were affected by the data breach.
The data breach class action lawsuit resolved by this settlement alleged that Nations Direct Mortgage failed to implement reasonable cybersecurity measures, which led to a December 2023 data breach. The breach allegedly compromised sensitive information such as Social Security numbers, birth dates and other identifiers.
Nations Direct Mortgage is a mortgage lender that offers a variety of loan products.
The company hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the data breach class action lawsuit.
Under the terms of the Nations Direct Mortgage settlement, class members can receive up to $2,750 in reimbursement for data breach losses. This payment covers fraudulent charges, identity theft losses, bank fees, credit report costs and more.
The Nations Direct Mortgage data breach settlement also compensates class members for up to two hours of lost time at a rate of $25 per hour, for a maximum lost time payment of $50.
Class members who reside in California can receive an additional one-time payment of $75 from the settlement.
All class members can receive two years of free credit monitoring services through the settlement. These services include $1 million in identity theft insurance, real-time credit file monitoring, dark web scanning, public records monitoring and more.
The deadline for exclusion and objection is Dec. 23, 2025.
The final approval hearing for the Nations Direct Mortgage data breach settlement is scheduled for Jan. 22, 2026.
To receive settlement benefits, class members must submit a valid claim form by Jan. 7, 2026.
Who’s Eligible
Individuals living in the United States who received notification from Nations Direct Mortgage that their private information was affected by the December 2023 data breach. California residents as part of a California sub class and NDM employees who have an arbitration agreement with NDM are included.
Potential Award
Up to $2,750 in documented losses due to the data breach, plus a $75 payment for California class members.
Proof of Purchase
Bank statements or receipts. Self-prepared notes or papers are insufficient to make a valid claim on their own.
