Homeowners who sold their homes on a multiple listing service and paid commission to a real estate brokerage could benefit from a $418 million National Association of Realtors settlement and a $250 million HomeServices settlement.
Other real estate brokerage firms have already entered into proposed Settlements, including Anywhere Real Estate, RE/MAX, Keller Williams, Compass, Real Brokerage, Realty ONE, @properties, Douglas Elliman, Redfin, Engel & Völkers, HomeSmart, United Real Estate, and certain of their affiliates. More may settle in the future.
The current value of all settlements is over $980 million.
The settlements benefit individuals who sold a home during certain eligible date ranges, listed their home on a multiple listing service (MLS) anywhere in the United States, and paid a commission to any real estate brokerage in connection with their home sale.
Eligible date ranges vary depending on which MLS a class member’s home was listed. Go to the www.RealEstateCommissionLitigation.com to learn more.
Plaintiffs claim NAR, HomeServices and other brokerage defendants conspired to require home sellers to pay inflated commissions to brokers or agents representing them. According to the class action lawsuit, this conspiracy violated the federal Sherman Act and other antitrust laws.
The defendants haven’t admitted any wrongdoing but agreed to an antitrust class action lawsuit settlement. HomeServices agreed to pay $250 million, and NAR agreed to pay $418 million. Between the NAR settlement, the HomeServices settlement, and other settlements reached with additional defendants, there is more than $980 million available for all settlements
If the Settlements are approved, Class members can receive a cash payment if they file a timely valid claim. No payment estimates are available at this time.
The deadline for exclusion and objection to the Settlements with NAR and HomeServices is Oct. 28, 2024.
The final approval hearing for the NAR settlement and Home Services settlement is scheduled for Nov. 26, 2024.
To receive NAR and HomeServices settlement benefits, class members must submit a timely valid claim form by May 9, 2025. Class members do not need to file multiple claim forms to benefit from multiple settlements. Filing one claim form for each eligible home sale allows you to receive payments from any settlements you are eligible for. You can access the claim form right here. If you have already submitted a Claim Form for a prior settlement with other Defendants, you do not need to submit another Claim.
