Instacart has agreed to pay nearly $11 million to resolve allegations that they misclassified their shoppers as independent contractors.
Class Members include individuals who performed certain covered services for Instacart between Sept. 1, 2017 and May 9, 2019. More information about covered in-store and delivery services is available in the “Who’s Eligible” section below.
Plaintiffs Kyra Groves, Catherine Hammons, Timothy Pierce, Javier Cortez, Donna Burks and Seth Blackham alleged they were wrongfully classified as independent contractors while working as shoppers for Instacart.
As a result of this wrongful classification, the plaintiffs were reportedly not reimbursed for their expenses, not paid proper wages and overtime, not provided with correct rest periods and were otherwise denied benefits they were owed as employees.
Instacart has not admitted to any wrongdoing but agreed to resolve the claims against them in this settlement. The settlement funds total $10,965,000 and will be used to pay court costs, attorneys’ fees, Private Attorney General Act penalties and other expenses, including Class Member payments.
Under the settlement, Class Members are eligible to recover a proportional share of the settlement fund based on services they performed.
Each claimant will be awarded one “point” for each hour of in-store services performed and two “points” for each hour of delivery services performed. These points do not have a fixed dollar amount and instead will be used to determine proportional payments based on how many Class Members file a valid claim.
In order to benefit from the settlement, Class Members must file a valid claim form by Feb. 21, 2020. The deadline for exclusion and objection was Nov. 14, 2019. The final approval hearing is scheduled for Feb. 21, 2020.
Who’s Eligible
Individuals who performed certain covered services for Instacart between Sept. 1, 2017 and May 9, 2019.
Covered services include:
- In-store services (accepting a customer’s order, receiving a customer’s selected items from a store, taking a customer’s order through checkout, ringing up a customer’s order at a checkout station, preparing the order for delivery, etc.)
- Delivery services (transporting a customer’s order from the retail store to a location specified by the customer, etc.)
Potential Award
Varies. Proportional payments will be awarded based on the hours of services performed and the number of Class Members who submit a valid claim.
Claimants will be awarded one “point” for each hour of in-store services performed and two “points” for each hour of delivery services performed. Points under the settlement do not have a fixed dollar amount.
