Gotham Process illegal debt collection $1.35M class action settlement

Gotham Process and other companies agreed to pay $1.35 million to resolve claims that they operated an illegal debt-collection scheme. 

The settlement benefits individuals who were sued by Mullooly, Jeffery, Rooney & Flynn LLP on behalf of Gotham Process in New York Civil Court since 2016 where Carl Bouton or Bassem Elashrafi handed court papers to a relative.

According to the class action lawsuit, Mullooly, Jeffery, Rooney & Flynn LLP and Gotham Process falsified court papers to consumers in an attempt to extract money in a fake debt-collection scheme. The scheme allegedly caused thousands of consumers to have lawsuits filed against them that resulted in default judgments due to a lack of lawful service.

Gotham Process is a tristate company that specializes in serving court processes. 

Gotham Process agreed to a $1.35 million settlement to resolve the debt collection class action lawsuit. 

Under the terms of the Gotham Process settlement, class members can receive a refund based on the amount Gotham collected from them during the class period. According to the settlement website, class members are expected to receive at least $200 but could receive full refunds. 

The deadline for exclusion and objection is Oct. 26, 2023. 

The final approval hearing for the settlement is scheduled for Nov. 16, 2023. 

In order to receive settlement benefits, class members must submit a valid claim form by Oct. 26, 2023.
