Giftly agreed to a $500,000 class action settlement to resolve claims of advertising merchant listings on its website without the merchcants’ consent.
The settlement benefits businesses, entities and individuals who were listed on the Giftly website without their agreement.
According to the class action lawsuit, Giftly wrongfully lists merchants on its gift card website without their consent in violation of state and federal laws. These businesses were allegedly financially injured by this conduct.
Giftly is an online gift card service that allows consumers to send gift cards that can be redeemed as Visa gift cards, Paypal credits or bank account deposits. The website offers a list of companies as “suggestions” for how to spend these funds.
Giftly hasn’t admitted any wrongdoing but agreed to a $500,000 settlement to resolve the class action lawsuit.
Under the terms of the Giftly settlement, claimants can receive a cash payment based on participation in the settlement’s Merchant Advertising Program. This program will direct Giftly traffic to authorized websites of class members.
If more than 1,000 class members enroll in this program, each claimant can receive an equal share of the $500,000 payment fund. If fewer than 1,000 class members enroll in the program, payments will be capped at $1,000 per claimant.
In addition to providing cash payments, Giftly agreed to make changes to its business practices, including improving gift recipient communication, allowing merchants to request their removal from the website and other measures.
The deadline for exclusion and objection is Sept. 25, 2023.
The final approval hearing for the settlement is scheduled for Nov. 14, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by Sept. 25, 2023.

Has there been any update on when payments will go out?
Stop trying to add your names after the fact, that’s fraud. I hope who ever commits fraud and receives any money from any of these lawsuits, I hope they get caught and spend 25 years in prison and be made to pay it all bck times 10
