GEICO agreed to pay $19.1 million as part of a class action settlement to resolve allegations it failed to pay sales tax when paying out total loss claims. 

The settlement benefits class members who were insured under California auto insurance policy through GEICO and were not paid either sales tax or regulatory fees on a claim submitted between June 27, 2015 (GEICO General), Oct. 23, 2016 (GEICO Indemnity), or June 30, 2017 (GEICO Casualty or Government Employees Insurance Company), through Aug. 27, 2020.

GEICO is an insurance company that offers automotive, homeowners, renters, motorcycle, boat and other insurance products. According to a class action lawsuit, GEICO fails to pay full total loss claims to automotive consumers.

When consumers get into a car accident, their vehicle may be declared a total loss if the damage to the vehicle eclipses the value of the car. In these cases, GEICO may pay a total loss claim for the actual cash value of the vehicle. 

However, according to plaintiffs in the case, GEICO fails to include sales tax and regulatory fees in these payments.

The GEICO class action lawsuit argues these payments violated both the company’s insurance policies and California state law. GEICO refutes these claims, arguing it complied with all applicable laws and regulations.

GEICO hasn’t admitted any wrongdoing but agreed to resolve these allegations with a $19.1 million class action settlement. GEICO agreed to a similar settlement with Florida policyholders.

Under the terms of the GEICO settlement, class members can receive a payment for unpaid regulatory fees of $6.88 and unpaid sales tax of 7.25% plus local sales tax.

According to the settlement website, average payment amounts are calculated to be $2,051.98. However, individual payments may be higher or lower.

GEICO will also change its business practices to begin prorating regulatory fees on total loss claim payments. This will ensure future payments include fees and other expenses are included in total loss payments according to applicable regulations.

The deadline for exclusion and objection is Oct. 27, 2022. 

The final approval hearing for the GEICO settlement is scheduled for Dec. 15, 2022.

In order to receive a payment from the settlement, class members must submit a valid claim form by Nov. 11, 2022.

Who’s Eligible

The settlement benefits class members who were insured under California auto insurance policy through GEICO and were not paid either sales tax or regulatory fees on a claim submitted between June 27, 2015 (GEICO General), Oct. 23, 2016 (GEICO Indemnity), or June 30, 2017 (GEICO Casualty or Government Employees Insurance Company), through Aug. 27, 2020.

    SOMEONE EXPLAIN TO ME WTF THIS MEANS: The plaintiffs represent that neither they nor the Defendant have identified any salvage-retained insureds who leased their vehicle. Id. ¶ 24. Therefore, Plaintiffs do not believe there is anyone who would qualify for the Sales Tax Class but for retaining a salvage vehicle. Id.

    I am now being threatened by Kirtland & Packard Law firm. After being ripped off and lied to during this class action by every attorney and their claim administrators do you think their threats scare me? Take me to court then, You’ll have to disclose your information and explain where our money went. I want a complete record of what was paid and to which members of the class. 19.5 million not enough for you, you felt entitled to take our settlement money too.. Show me your records.     Anyone telling you they got their check is a liar. Look at all the tricks they pull. First, they send out some mailers declared undeliverable. That is one game, then it’s they have the wrong address. or it’s in the mail. They are trying to run out the statute of limitation clock. I am making moves to get my money. I have written to the Judge who heard the case, the Inspector General, AG, State Bar, BBB, members of Congress, and media outlets. as well as Yelp. they changed names and took down their website. they block all class members from sending emails. They are thieves, criminals, and all those saying they got their check are their fkg paralegals pushing the time out. I am fighting for everyone and in all y letters I include the entire class as being victims of their theft. dont fall for it. email me at high main LLC at g mail. algorithm you know. put it together.       JND Legal Administration took the case on and I got an email saying that I was involved in that class action lawsuit against Geico well that company seems to never respond back I’ve left them several emails and I’ve called their number and nobody responds to go straight to voicemail and I received a check from the Geico lawsuit and it wasn’t even enough to cover the tax and title for two cars that Geico didn’t pay for correctly and that’s what the lawsuit was against Geico for but I got $102 check which wasn’t enough to cover diddly squat when the lawyers got 19.5 million dollars from the Geico lawsuit so I’m guessing everybody else will get nothing as well as I was supposed to have got $4,000 from the lawsuit is what they told me I was going to get but instead all they gave me was that $102 which ain’t the least squat the cover taxes and titles on two different vehicles but just be aware that if you are involved in the lawsuit against Geico in Ohio that you will not get much like they lie and say you will

    To every Attorney involved in GEICO Case 4:19-cv-03768-HSG and Case Perez v. Geico
    4:20-cv-07436, this letter is for you.

    In case you are confused about people being stupid, allow me to correct you on your assumption. We are not the idiots you think we are. The members who you stole from, are quite smart. So smart in fact, that we are all united together and are ready to take action unless you correct the fraud that has been committed by your company of attorneys against the class members of the above cases.

    Our demands are quite simple and just. In my opinion, after all the stress and suffering your attorneys caused, I would rather go directly to the news media and shout it on air for the world to hear, but the majority of the class action members, just want what you should have paid. That is the amount of 2051.98 dollars that you stole from class members.

    I will have and will show, proof that the Attorneys at KCC Class Action Services, LLC of San Rafael, CA, who represented Class Members, committed Securities Fraud by filing false documents with the claims administrator in charge of distributing the settlement checks, to members of the above cases.

    In addition, every attorney on record violated Federal Rules of Civil Procedures Class Action Rule 23(b)(3). What that is, is FRAUD. Not any old fraud, but SECURITIES FRAUD. That is punishable by up to 20 years in prison.

    Here’s what is going to happen. You are going to issue checks to every person in this class action, you stole from, in the amount of $2051.98 each. If I hear from anyone that their check never got delivered or any other trick you try to pull, I will call the U.S. Securities and Exchange Commission and give them all the proof I have obtained, of your crimes, and you and all those that took part in this fraud will be arrested and put in jail.

    I will not contact you, or waste another second on wondering where the check are, or whether or
    not its in the mail. My next phone call will be to the authorities. You have 10 days from this letter,
    to pay everyone that you defrauded, their $2051.98.

    LOOK THEM UP UNDER THE BBB. TONS OF COMPLAINTS BY TONS OF PEOPLE. SAME SCAM. THEY’LL REISSUE THE CHECK. IT SHOWS DELIVERED BUT YOU NEVER GOT IT. THEY SEND A LETTER REGISTERED MAIL BUT THE ENVELOPE THEY SEND IS EMPTY. THEY HAVE PROOF IT WAS SENT BUT YOU KNOW YOU NEVER GOT, AND AROUND AND AROUND WE GO.
