Gastroenterology Consultants PA (GCPA) has agreed to a settlement resolving consumer claims that the business did not adequately protect consumers from a data breach to GCPA’s computer systems on or around Jan. 10, 2021.
A class has been established consisting of all individuals who received a notification from GCPA about the data incident. Additionally, a subclass has been established, consisting of individuals who received a notice that their Social Security number was potentially compromised in the data breach.
Allegedly, a range of personal information was exposed in the GCPA data breach, including the Social Security numbers of some individuals.
GCPA is based in Texas and offers care such as colorectal cancer screenings, pH monitoring, endoscopic ultrasound and other services related to the digestive tract.
Under the terms of the settlement agreement, class members are eligible for a cash payment.
All class members are eligible to receive up to $500 to compensate for out-of-pocket expenses incurred related to the data breach. These expenses may include, but are not limited to:
- Losses incurred due to fraud and identity theft
- Fees paid to professionals (including attorneys, accountants, etc.) in light of the identity theft
- Credit monitoring costs
Included within the $500 of compensation, class members may make claims for compensation for up to three hours of time spent dealing with the data incident, at a rate of $20 per hour.
All class members are eligible to make claims for up to $4,000 in extraordinary expense reimbursement. Documentation is required for such claims.
In addition, all class members are eligible to receive 18 months of credit-monitoring services.
Social Security Number Subclass members are eligible to receive 18 months of IdentityForce RapidResponse Premium credit monitoring. All other class members are eligible to receive 18 months of IdentityForce RapidResponseID.
Gastroenterology Consultants PA does not admit any wrongdoing in response to the claims regarding the data incident, but the company has agreed to the settlement to avoid the continued costs and risks of litigation.
The deadline to opt out of the GCPA settlement, submit a dispute or file an objection to the settlement is Aug. 4, 2022.
Class members are invited to attend a final fairness hearing in the GCPA data breach settlement, scheduled for Oct. 21, 2022.
The deadline to submit a claim for benefits from the Gastroenterology Consultants PA data breach settlement is Oct. 3, 2022.

Potential Award
Up to $4,500, plus credit monitoring
Proof of Purchase
Documentation of out-of-pocket expenses is required, as well as documentation demonstrating your reasonable efforts to avoid, or seek reimbursement for the expenses, including exhaustion of all available credit monitoring insurance and identity theft insurance. If you are seeking reimbursement for credit reports, credit monitoring, or other identity theft insurance product purchased between January 10, 2021 through August 6, 2021, you MUST attach a copy of a receipt or other proof of purchase for each credit report or product purchased.
