FiveStrata and First American agreed to a $700,000 settlement to resolve claims that they violated the federal Telephone Consumer Protection Act (TCPA) with unsolicited telemarketing calls to numbers on the National Do Not Call Registry.
The settlement benefits individuals who received calls from or on behalf of First American Home Warranty Corp. and/or FiveStrata LLC while their number was on the National Do Not Call Registry.
Plaintiffs in the class action lawsuit claim FiveStrata and First American contacted them with telemarketing phone calls despite their numbers being on the National Do Not Call Registry. According to the class action lawsuit, these calls violated the TCPA.
FiveStrata provides residential solar leads for clients. First American Home Warranty Corp. is a home warranty provider.
FiveStrata and First American have not admitted wrongdoing but agreed to a $700,000 class action lawsuit settlement to resolve the TCPA claims. First American will contribute $450,000 to the settlement fund, and FiveStrata will contribute $250,000.
Under the settlement terms, class members can receive an equal share of the net settlement fund. Payments will vary depending on the number of valid claims filed, but class counsel estimates that each claimant will receive around $110.
The deadline for exclusion and objection is April 30, 2024.
The final approval hearing for the FiveStrata and First American settlement is scheduled for June 30, 2024.
In order to receive settlement benefits, class members must submit a valid claim form by April 30, 2024.

I get calls too
I added my number, my husband and our office number to the do not call and it seems like ever since we got triple the calls from telemarters. We get more Telemarketer calls than we do business calls. Or personal calls. It’s very annoying. I wish I never added our numbers to it honestly. They start calling b4 we are even out of bed & the weekends are the worst too. We just have our cell phones no house phone. We can’t shut our phones off incase of an emergency so as the calls come in we block them.
I got these annoying calls too
they kept calling me 10 times a day
Myself, my husband’s and my landline has been registered on the no call list but they keep calling. I have blocked them but just call from other numbers
I’ve enrolled my number & my husband’s number on the NDNC list & have been overloaded with these calls multiple times a day, every day, and the number that calls you is never a working number that you can call them back on.
