Eye Physicians of Central Florida agreed to a class action settlement to resolve claims it failed to prevent a 2023 data breach that compromised patient information.

The class action settlement benefits consumers who received a data breach notification from Eye Physicians of Central Florida informing them that their information may have been compromised in a data breach in November 2023.

The Eye Physicians of Central Florida data breach occurred in November 2023 and compromised names, addresses, birth dates, medical information, insurance data and financial information, according to a class action lawsuit against the company. Plaintiffs in the case claim the company could have prevented the data breach through reasonable cybersecurity measures.

Eye Physicians of Central Florida is an ophthalmology practice with locations in Orlando, Winter Park and Clermont.

Eye Physicians of Central Florida has not admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the data breach class action lawsuit.

Under the terms of the Eye Physicians settlement, class members can receive a cash payment for documented data breach losses. Ordinary losses are capped at $2,000 and include bank fees, communication charges, travel expenses and up to three hours of lost time at a rate of $25 per hour.

Extraordinary losses are capped at $7,500 and include unreimbursed monetary losses due to fraud or identity theft resulting from the data breach.

All class members, regardless of whether they experienced losses, can receive two years of free credit monitoring services through the settlement.

The deadline for exclusion and objection is April 29, 2026.

The final approval hearing for the Eye Physicians data breach settlement is yet to be scheduled.

To receive settlement benefits, class members must submit a valid claim form by May 15, 2026.


Who’s Eligible

The class action settlement benefits individuals who live in the United States and who were notified by Eye Physicians of Central Florida that their information may have been compromised in the November 2023 data breach.

Potential Award

Up to $2,000 in ordinary losses or $7,500 in extraordinary losses.

Proof of Purchase

Documentation of losses, such as bank statements, invoices, receipts and phone records.
