Orlando Family Physicians agreed to a class action lawsuit settlement to resolve claims surrounding a 2021 health care data breach.
The settlement benefits consumers who received a data breach notification from Orlando Family Physicians informing them their personal information and/or protected health information may have been compromised in a data breach on April 15, 2021.
In April 2021, hackers allegedly gained access to private health information and personal identifiers stored on Orlando Family Physicians networks. According to a class action lawsuit against the medical provider, the data breach could have been avoided through reasonable cybersecurity protections.
Orlando Family Physicians is a group of medical centers in Orlando, Florida, that provides primary care services to thousands of patients.
Orlando Family Physicians hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the data breach class action lawsuit.
Under the terms of the settlement, class members who experienced out-of-pocket expenses as a result of the data breach can receive up to $225 for documented expenses. These payments will cover bank fees, communication costs, credit-related expenses and up to three hours of lost time at a rate of $25 per hour.
Class members whose Social Security numbers were compromised in the data breach can receive up to $7,500 in extraordinary expense reimbursement for unreimbursed fraudulent charges resulting from the data breach or fraud traceable to the data breach. These payments also include up to eight hours of lost time at a rate of $25 per hour.
All class members, regardless of if they experienced losses as a result of the data breach, are eligible for two years of free credit monitoring and identity theft insurance through IDX.
The deadline for exclusion and objection is June 1, 2023.
The final approval hearing for the Orlando Family Physicians class action lawsuit settlement is scheduled for Aug. 28, 2023.
To receive settlement benefits, class members must submit a valid claim form by July 1, 2023.
