Two Midwest Enterprise franchises agreed to pay nearly $505,000 to resolve claims they violated the Illinois Biometric Information Privacy Act (BIPA) by requiring employee finger scans for timekeeping.
The settlement benefits individuals who scanned their fingers for timekeeping purposes while working for Enterprise Leasing Co. of Chicago or Enterprise Rent-A-Car Co. Midwest LLC in Illinois between April 3, 2015, and Jan. 3, 2023.
According to the class action lawsuit, Enterprise Leasing Co. of Chicago or Enterprise Rent-A-Car Co. Midwest LLC violated Illinois privacy law by failing to provide disclosures and get consumer consent before requiring workers to use their fingerprints to clock in and out of work.Â
Enterprise is a rental car company with over 8,000 locations across the globe.Â
The Enterprise companies haven’t admitted any wrongdoing but agreed to a $504,968.75 class action settlement to resolve the BIPA allegations.Â
Under the terms of the Enterprise employee BIPA settlement, class members can receive an equal share of the net settlement fund. Class counsel estimates each class member will receive between $400 and $500. However, exact payments may be higher or lower based on the number of participating class members.
The deadline for exclusion and objection is April 10, 2023.
The final approval hearing for the settlement is scheduled for May 4, 2023.
No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive a settlement payment.
