Norfolk Southern agreed to a $600 million East Palestine settlement to resolve claims surrounding a 2023 train derailment.

The settlement benefits individuals and entities who lived, worked, owned property and/or operated a business within 20 miles of the East Palestine, Ohio derailment site between Feb. 3, 2023, and April 26, 2024.

On Feb. 3, 2023, a Norfolk Southern freight train transporting hazardous chemicals derailed in East Palestine, Ohio, exposing locals to the chemicals and forcing a controlled burn of several railcars on Feb. 6. Residents and business owners quickly took legal action against Norfolk Southern, arguing the derailment was a direct result of the company’s negligence and led to serious injuries and losses.

Norfolk Southern is a railway company that ships chemicals, agriculture products, vehicles and raw materials to 22 states.

Norfolk Southern hasn’t admitted any wrongdoing but agreed to pay $600 million to resolve the train derailment class action lawsuit.

Under the terms of the settlement, class members can receive a cash payment based on the damages they experienced and their distance from the derailment site. Households zero to two miles from the site are estimated to receive around $70,000. Households two to four miles from the site are estimated to receive around $45,000. Households four to seven miles from the site are estimated to receive around $30,000. Households seven to 10 miles from the site are estimated to receive around $15,000. Households 10 to 15 miles from the site are estimated to receive around $500. Households 15 to 20 miles from the site are estimated to receive around $250.

Class members who experienced physical injuries, medical treatments and other personal injuries can receive cash payments based on their distance from the derailment site. Class members zero to two miles from the site are estimated to receive around $10,000. Class members two to five miles from the site are estimated to receive around $5,000. Class members five to 10 miles from the site are estimated to receive around $1,000. Class members who suffered from extraordinary injuries may be eligible for additional compensation.

Class member businesses can receive compensation for business losses related to the incident. Exact payments will vary depending on the number of itemized claims and whether they have already received payments from Norfolk Southern or other sources.

The deadline for exclusion and objection is July 1, 2024.

The final approval hearing for the settlement is scheduled for Sept. 25, 2024.

To receive an East Palestine settlement payment, class members must submit a valid claim form by Aug. 22, 2024.

    I am disgusted that they’re giving some folks only $500!!! This settlement in noway will actually cover the expenses these people had. They should be ashamed of themselves for offering such low amounts.

      I lived at 651 E. Taggert during this incident. Which two weeks after I relocated to Las Vegas to stay with family due to the effects of the train derailment. I suffered nose and eye irritation, coughing and wheezing, nausea, vomiting, diarrhea, rashes and feeling weak and tired even at times. It was a horrible two weeks. I tried to self medicated but to no avail. So it was only one option to leave. I’ll never forget that day.
