Chick-fil-A agreed to a $4.4 million settlement to resolve a class action lawsuit claiming that the fast food chain misrepresented its delivery fees and menu prices; class members must submit a claim form to benefit.

The settlement benefits consumers who made a Chick-fil-A delivery order through the Chick-fil-A app or website between Nov. 1, 2019, and April 30, 2021, from a Chick-fil-A location in California, Florida, Georgia, New Jersey or New York.

Plaintiffs in the class action lawsuit accused Chick-fil-A of misrepresenting its delivery service as a free or low-cost option while simultaneously raising menu prices on delivery orders in order to charge hidden fees. According to the class action lawsuit, Chick-fil-A intentionally misled consumers about its delivery costs in order to deceive them into making purchases.

Chick-fil-A is a fast-food chain that serves chicken products.

Chick-fil-A hasn’t admitted any wrongdoing but agreed to pay $4.4 million to resolve the delivery fee class action lawsuit.

Under the terms of the Chick-fil-A class action lawsuit settlement, class members who submit a valid claim form can receive either a cash payment or a gift card award, both worth $29.25 per claimant. Of the settlement fund, $1.45 million will be used to fund cash payments, and $2.95 million will be used to fund gift card awards. 

If the number of claims filed in either of these funds exceeds the allotted fund total, payments and gift card awards will be reduced on a pro rata basis.

The deadline for exclusion and objection is Jan. 2, 2024.

The final approval hearing for the Chick-fil-A class action settlement is scheduled for Feb. 29, 2024.

In order to receive benefits under the Chick-fil-A class action lawsuit settlement, class members must submit a valid claim form by Feb. 15, 2024.
