Convergent Outsourcing agreed to a $2.45 million settlement to resolve claims that it failed to prevent a 2022 Convergent Outsourcing data breach.

The settlement benefits individuals who received a notification from Convergent Outsourcing informing them their information may have been compromised in a data breach discovered June 17, 2022.

According to the Convergent Outsourcing data breach class action lawsuit, the company failed to prevent a 2022 data breach that compromised Social Security numbers, financial account information and other sensitive data. Plaintiffs in the case argue that Convergent could have prevented the data breach by implementing reasonable cybersecurity measures.

Convergent Outsourcing is a debt-collection agency with an “F” rating on the Better Business Bureau due to consumer complaints of harassing phone calls and other wrongdoing.

Convergent Outsourcing hasn’t admitted any wrongdoing but agreed to a $2.45 million settlement to resolve the data breach class action lawsuit.

Under the terms of the Convergent Outsourcing data breach settlement, class members can receive up to $1,500 for ordinary data breach losses such as fraud or identity theft damages, credit expenses, bank fees, communication charges, travel expenses and up to 10 hours of lost time at a rate of $30 per hour. 

Class members can also claim up to $10,000 for extraordinary losses reasonably traced to the data breach, including identity theft damages, fraudulent damages, falsified tax returns and other misuse of personal information.

Alternatively, class members may file a claim to receive a pro rata payment. If settlement costs, fees, expenses, service awards and payments for claims exceed the amount of the settlement fund, class members who choose the alternate payment option may not receive a payment.

The deadline for exclusion and objection is May 20, 2024.

The final approval hearing for the settlement is scheduled for July 19, 2024.

In order to receive benefits under the Convergent Outsourcing data breach settlement, class members must submit a valid claim form by June 19, 2024.
