A $700,000 Henry Ford Health System settlement resolves claims the company failed to protect patients from a 2023 data breach.
The settlement benefits consumers whom Henry Ford mailed a written data breach notification informing them that their information may have been compromised by a cyber incident on March 30, 2023.
According to plaintiffs in the class action lawsuit, Henry Ford Health System should have implemented reasonable cybersecurity measures to protect patients from a 2023 data breach. This breach allegedly compromised the names, medical charts, contact information and other data of around 168,000 patients.
Henry Ford Health System is an academic medical center in Michigan.
Henry Ford has not admitted any wrongdoing but agreed to pay $700,000 to resolve the data breach class action lawsuit.
Under the terms of the settlement, class members can receive up to $2,500 in reimbursement for documented data breach-related expenses or a pro rata cash payment that will vary depending on the number of claims filed and other factors. Proof of damages is required to receive reimbursement, but no proof is required to receive a pro rata payment.
All class members, regardless of which payment option they choose, can receive one free year of two-credit bureau credit monitoring and $1 million in identity theft insurance. Class members can claim this benefit even if they took advantage of previous credit monitoring Henry Ford offered.
The deadline for exclusion and objection was Sept. 28, 2024.
The final approval hearing for the settlement is scheduled for Oct. 29, 2024.
To receive Henry Ford Health System settlement benefits, class members must submit a valid claim form by Oct. 28, 2024.
