Overby-Seawell and KeyBank agreed to pay $5 million to resolve claims they failed to prevent a 2022 banking data breach.
The settlement benefits individuals who received a data breach notification from Overby-Seawell, KeyBank or Fulton Bank informing them that a July 2022 cybersecurity incident may have compromised their personal information.
According to the data breach class action lawsuit, a 2022 breach of Overby-Seawell’s computer systems allowed hackers to gain access to information for current and former Overby-Seawell, KeyBank and Fulton Bank customers. Plaintiffs in the case claim this theft of information injured them and argue Overby-Seawell should have prevented the breach by implementing reasonable cybersecurity measures.
Overby-Seawell is a provider of compliance services, insurance tracking and other technology solutions used by banks, such as KeyBank.
Overby-Seawell and KeyBank have not admitted any wrongdoing but agreed to a $6 million settlement to resolve the banking data breach class action lawsuit.
Under the terms of the settlement, class members can receive up to $6,000 in reimbursement for documented data-breach related losses including fraud damages, identity theft damages, fees, credit costs and up to five hours of lost time compensated at a rate of $25 per hour. Class members without documented expenses can instead receive a pro rata payment that will vary depending on the number of claims filed and other factors. All class members from California will receive an additional $100 payment on top of their primary payment option.
Class members are also eligible for three years of free identity theft protection and credit monitoring services. These services include three-bureau monitoring and at least $1 million in fraud/identity theft insurance.
The deadline for exclusion and objection is Sept. 20, 2024.
The final approval hearing for the settlement is scheduled for Dec. 9, 2024.
To receive settlement benefits, class members must submit a valid claim form by Oct. 21, 2024.
