
Three oil and gas companies agreed to pay a total of $555,000 to resolve claims that their wastewater disposal wells caused earthquakes in Oklahoma that resulted in property damage.
The Oklahoma earthquake settlement benefits anyone who owned real property in Oklahoma between Jan. 19, 2019, and Feb. 2, 2024, and whose property suffered damage from earthquakes, foreshocks and aftershocks.
The Oklahoma earthquake class action settlement resolves a class action lawsuit that claims Spess Oil Co., Circle 9 Resources and Culbreath Oil & Gas Co. Inc. caused earthquakes in Oklahoma through their wastewater disposal wells. The plaintiffs in the case say these earthquakes caused damage to their properties.
The three companies have not admitted any wrongdoing but agreed to a $555,000 settlement to resolve allegations in the class action lawsuit.
Under the terms of the Oklahoma earthquake settlement, class members can receive a cash payment based on the amount of damage their properties sustained from the earthquakes.
The settlement will be divided into two zones based on the location of the damaged properties. Zone A includes Lincoln, Payne, Logan, Oklahoma, Cleveland, Pottawatomie, Seminole, Okfuskee and Creek counties in Oklahoma. Zone B includes all other counties in Oklahoma.
Ninety percent of the settlement fund will be used to pay claims from Zone A, while 10% will be used to pay claims from Zone B. If the total amount claimed by class members is less than the total settlement fund, all class members will receive a pro rata payment. If the total amount claimed exceeds the settlement fund, class members will receive a proportional share of the net settlement fund based on the amount they claimed.
The deadline for exclusion was Sept. 27, 2025, and the deadline for objection was Oct. 10, 2025.
The final approval hearing for the Oklahoma earthquake settlement was Oct. 20, 2025.
To receive a settlement payment, class members must submit a valid claim form by Jan. 25, 2026.
Who’s Eligible
The settlement benefits individuals, municipalities, county governments and tribal governments that owned or had an interest in real property in Oklahoma between Jan. 19, 2019, and the effective date of the settlement and suffered earthquake damages from earthquakes, foreshocks and aftershocks within the state of Oklahoma.

Claimants must provide evidence of damages suffered as a result of the Feb. 2, 2024, earthquake occurring near Prague, Oklahoma, and/or any other earthquakes in other areas of Oklahoma, including but not limited to the 5.1M earthquake occurring on Feb. 2, 2024, having an epicenter near Prague, Oklahoma. Claimants must also provide repair estimates and bills.
