HealthEC agreed to pay over $5.4 million as part of a class action lawsuit settlement to resolve claims it failed to prevent a 2023 data breach that compromised sensitive patient information.

The HealthEC settlement benefits individuals whose personal information and/or protected health information was compromised in the data breach announced in December 2023.

The HealthEC data breach reportedly compromised the sensitive health and personal information of around 1.52 million individuals. HealthEC is a technology company that provides healthcare data analytics services to healthcare entities.

Affected individuals filed a class action lawsuit claiming that HealthEC and its clients failed to protect their information from cybercriminals despite the growing trend of data breaches in the healthcare industry.

HealthEChas not admitted any wrongdoing but agreed to a $5.48 million class action settlement to resolve these allegations.

Under the terms of the HealthEC settlement, class members can receive a cash payment or out-of-pocket losses, including lost time.

Class members can claim reimbursement for unreimbursed out-of-pocket expenses incurred as a result of identity theft or fraud, credit-related expenses, miscellaneous expenses related to the data breach, and up to 10 hours of lost time at a rate of $25 per hour. No maximum limit for out-of-pocket expenses is listed in the settlement notice.

Class members who did not experience out-of-pocket losses or lost time can still receive a cash payment of at least $25 from the settlement. Alternate cash payments for California residents will be $50.

In addition to cash payments, class members can receive three years of free Medical Shield Complete services. These services include medical and healthcare data monitoring, credit file monitoring, dark web monitoring, security freeze capability and a $1 million identity theft insurance policy.

The deadline for exclusion is Nov. 18, 2025 and the deadline for objection is Dec. 22, 2025.

The final approval hearing for the HealthEC data breach settlement is scheduled for Jan. 18, 2026.

To receive settlement benefits, class members must submit a valid claim form by Nov. 18, 2025.
