Old Lyme Gourmet agreed to pay $4 million to resolve claims it advertised Deep River chips as non-GMO when, in reality, they contained GMO ingredients.
The Old Lyme settlement benefits consumers who purchased Deep River potato chips labeled as containing “non-GMO ingredients” between Feb. 2, 2017, and Dec. 6, 2024.
According to the false advertising class action lawsuit,Old Lyme falsely advertised Deep River Snacks with a “non-GMO ingredients” graphic. This graphic allegedly tricked consumers into believing a reputable third party, such as the Non-GMO Project, certified the snacks.
Old Lyme Gourmet manufactures snacks under the Deep River Snacks brand.
The company hasn’t admitted any wrongdoing but agreed to a $4 million settlement to resolve the false advertising class action lawsuit.
Under the terms of the Old Lyme settlement, class members can receive $5 for the first product they purchased and $0.50 for each additional purchased product. With proof of purchase, claimants can claim as many products as they have proof for with no maximum limit. Without proof of purchase, claimants can claim up to 10 products for a total maximum payment of $10.
The deadline for exclusion and objection is March 25, 2025.
The final approval hearing for the settlement is scheduled for May 15, 2025.
To receive settlement benefits, class members must submit a valid claim form by July 28, 2025.
