A California federal judge has preliminarily approved a settlement in a class action lawsuit accusing Salov North America Corp. of inappropriately marketing its Filippo Berio brand olive oil as “Imported from Italy.” If you purchased Filippo Berio olive oil between May 23, 2010 and June 30, 2015, you may be eligible to claim at least $2 — or more — from the class action settlement.
The Filippo Berio settlement resolves a 2014 class action lawsuit filed by plaintiff Rohini Kumar, who alleged consumers were misled into believing they were purchasing olive oil made in Italy.
According to the lawsuit, the front label on Filippo Berio olive oil products states “Imported from Italy,” but the fine print on the back of the bottle discloses that most of the olive oil in the Product comes from olives grown in other countries that are shipped to Italy for blending and bottling before being exported to the United States.
Kumar argued that consumers would not have purchased Filippo Berio olive oil, and/or would not have paid as much money as they did for the product, if not for the “Imported From Italy” label.
Salov North America denies any wrongdoing and tried unsuccessfully to dismiss the class action lawsuit last year.
U.S. District Judge Yvonne Gonzalez Rogers certified a Class of California consumers in July 2016. She preliminarily approved the deal on January 27, 2017.
Who’s Eligible
Class Members of the Filippo Berio olive oil settlement include anyone who purchased the following products in the United States between May 23, 2010 and June 30, 2015 that were labeled as “Imported from Italy”:
- Filippo Berio Robusto Extra Virgin Olive Oil,
- Filippo Berio Extra Virgin Olive Oil
- Filippo Berio Delicato Extra Virgin Olive Oil
- Filippo Berio Organic Extra Virgin Olive Oil
- Filippo Berio Olive Oil
- Filippo Berio Light Tasting Olive Oil
Potential Award
$2 – $5 without proof of purchase, or $0.50 per bottle with proof of purchase.
The Filippo Berio settlement will provide Class Members a cash payment of $0.50 per can or bottle purchased. A minimum of $2.00 will be paid to any class member who submits a valid claim for one to four (1 – 4) Products purchased. Class Members can submit claims for up to 10 bottles or cans purchased (up to $5.00 per household) without proof of purchase. Proof of purchase is required to submit claims for more than $5.00 per household (for more than 10 bottles or cans purchased).
Proof of Purchase
- Proof of Purchase is not required for claims of up to 10 Products purchased per household (i.e., for a cash payment up to $5.00 per household).
- Proof of Purchase is required for claims of more than 10 Product Packages.
“Proof of Purchase” means an itemized retail sales receipt or retail store club or loyalty card record showing, at a minimum, the purchase of a Product, the purchase price, and the date and place of the purchase.

UPDATE 3: On September 11, 2018, the Ninth Circuit Court of Appeals affirmed the Filippo Berio Olive Oil Class Action Settlement. It is not known how quickly claims will be paid. Let Top Class Actions know when you receive a check in the comments section below or on our Facebook page.
