DuPont Paint Price-Fixing Class Action Settlement

TCA viewers report receiving checks worth up to $105.17 from the DuPont Titanium Dioxide Architectural Paint class action settlement.

Lead plaintiffs accused DuPont of conspiring with other chemical companies to hike the price of a paint ingredient, titanium dioxide.

The scheme had gone on since 2002, according to the plaintiff, and had led to paint buyers paying artificially high prices for architectural paint.

Architectural paint is “pigmented liquid, liquefiable, or mastic composition designed for application to a substrate in a thin layer which is converted to an opaque solid film after application containing titanium dioxide.”

DuPont agreed to pay $3.5 million to settle the class action lawsuit, without admitting to any wrongdoings.

Class Members included those who purchased DuPont Architectural Paint containing titanium dioxide from Jan. 2, 2002 until Dec. 13, 2017.

Only Class Members from approximately 30 states were entitled to make a claim for $0.76 per gallon of paint.

The deadline to file a claim for the DuPont paint class action settlement passed on June 15, 2018.

Class Members in the DuPont paint class action settlement are represented by Don Barrett of Barrett Law Group and Jonathan W. Cuneo of Cuneo Gilbert & LaDuca LLP.

The DuPont Paint Price-Fixing Class Action Lawsuit is Jan Harrison, et al. v. E.I. DuPont De Nemours and Company, et al., Case No. 5:13-cv-01180-BLF, in the U.S. District Court for the Northern District of California, San Jose Division.

Filippo Berio Olive Oil Class Action Settlement

TCA viewers are also reporting that they’ve received checks for up to $5 from the Filippo Berio olive oil class action settlement.

Consumers accused the makers of Filippo Berio olive oil of falsely advertising the product as “Imported from Italy.”

The plaintiff said that product packaging made it seem as if the olive oil was sourced from Italy, when, in fact, the olives used in Filippo Berio Olive Oil came from other countries to be blended in Italy.

The manufacturer, Salov North America Corp., agreed to settle the class action lawsuit after the proposed Class was certified and after losing an attempt to dismiss the case.

Class Members included those who purchased Filippo Berio Olive Oil between May 23, 2010 and June 30, 2015.

The deadline to file a claim for the Filippo Berio Olive Oil class action settlement passed on May 2, 2017.
