Applicants who applied for a job at Baptist Memorial Health Care and had a background report prepared for them could benefit from a $420,566 settlement.

The settlement benefits two classes: the disclosure class and the pre-adverse action subclass.

The disclosure class includes individuals who applied for a position with Baptist Memorial Health Care and who had a background report procured for them between June 7, 2019, and Aug. 8, 2022.

The pre-adverse action subclass includes class members who were not hired by Baptist Memorial Health Care; who are marked in the company’s system as “failed background report,” “null” or “other;” and whom Baptist Memorial hasn’t been able to confirm received a pre-adverse action notice.

Plaintiffs in the class action lawsuit claim Baptist Memorial Health Care failed to comply with the Fair Credit Reporting Act when procuring consumer reports on and taking action against job applicants. The health care system allegedly failed to provide the disclosures required by FCRA.

Baptist Memorial is a hospital and health care system with locations in Tennessee, Missouri and Arkansas.

Baptist Memorial Health Care hasn’t admitted any wrongdoing but agreed to pay $420,566 to resolve the FCRA class action lawsuit.

Under the terms of the settlement, class members can receive cash payments based on their class membership. Members of the disclosure class can receive up to $26, while members of the pre-adverse action class can receive up to $500.

The deadline for exclusion and objection is July 12, 2024.

The final approval hearing for the settlement is scheduled for Sept. 19, 2024.

To receive settlement payments, class members must submit a valid claim form by July 29, 2024.
