Drivers could benefit from a $33.5 million Geico Texas total loss settlement if the insurance company underpaid their vehicle total loss claims due to unlawful deductions.
The settlement benefits individuals insured under a Geico Texas private passenger automobile insurance policy that defined actual cash value under Section III of the policy as โthe replacement cost of the auto or property less depreciation and/or bettermentโ and who made a first-party physical damage claim paid as a total loss between May 5, 2016, and March 18, 2024.
Plaintiffs in the total loss class action lawsuit claim Geico unlawfully reduced their total loss payments by failing to compensate for full regulatory fees after a loss. These fees, which include title transfer fees, registration fees, inspection fees and others, are allegedly required to register a new vehicle in Texas.
Geico is an insurance company that covers vehicles, homes, renters, motorcycles and more.
Geico hasnโt admitted any wrongdoing but agreed to pay $33.5 million to resolve the total loss class action lawsuit.
Under the terms of the Geico Texas total loss settlement, class members can receive up to $80. Actual payment amounts may be reduced depending on the number of valid claims filed.
The deadline for exclusion and objection was June 25, 2024.
The final approval hearing for the settlement is scheduled for Aug. 1, 2024.
To receive a Geico Texas total loss settlement payment, class members must submit a valid claim form by July 10, 2024.
