XL Foods Beef

XL Foods Inc. has agreed to pay $4 million to settle allegations that beef products processed at a facility in Alberta, Canada resulted in a 2012 E. coli recall.

The XL Foods class action lawsuit accuses the company of negligence, specifically in the design and implementation of control, sampling and testing procedures. According to the complaint, XL Foods was also sloppy when it came to managing the product recall. 

E. coli typically shows symptoms within one to 10 days after exposure. Symptoms may include: severe stomach cramps, watery or bloody diarrhea, vomiting, nausea, headache, and little or no fever. Some people can develop more serious consequences, such as kidney failure, seizures and stroke.

The XL Foods beef class action seeks to reimburse Class Members for a full refund if they purchased the recalled beef and can show documentation to support their claim. All other individuals who consumed the recalled XL beef and cannot show proof of purchase will receive $25 CDN.
UPDATE: On May 9, 2019, Top Class Actions viewers started receivingchecks in the mailfrom the XL Foods E. coli contamination class action settlement, worth as much as $1,700.

Who’s Eligible

XL Foods class action lawsuit settlement Class Members include all individuals in Canada and the U.S. who: purchased recalled XL Beef (for private, non-commercial consumption) and suffered an economic loss; purchased unidentifiable beef (for private, non-commercial consumption) and suffered an economic loss; or consumed recalled XL Beef and suffered a physical illness or injury.

Potential Award

$25 CDN – Full Refund

XL Foods settlement Class Members who submit a proof of purchase will receive a full refund.

Class Members who file a Claim Form without a receipt will receive $25 CDN.

Class Members without a receipt can still file a Claim Form in order to receive $25 CDN. Those individuals who are able to submit supporting documents along with their Claim Form will be able to receive a full refund.

    Did anyone else receive letters of compromise for $500 and only get a $283.05 payment if so did you know that the three years we waited for payments the class action original settlement amount of 4 million earned interest and that is to be added into the settlement amount fund as part of the distribution I’d like to know how they can go from offering $500 Canadian 2 class-action claimants as a settlement offer and only receive $283 American with the reasoning being that there were more claims that cut into the amount received per claimant because they knew how many claims they had prior emailing class action members that had bodily injury claims there proposed offering to settle. The claim filing dated already closed and when everyone received their email in August or September of 2018 class action Ministry to already knew how many bodily injury claims there was an at what level the injury was categorized at so to use the reason that the offer is going to be last because of the amount of people is to give the false impression that they did not have the number of claimants that filed bodily injury which is bullshit. I think they need to submit all info regarding how many claims were just for the economic loss how many claims were for bodily injury and how many claimants per category a bodily injury there was so we can see for ourself that’s okay yeah there were an extra hundred thousand bodily injury claims or whatever it is they’re going to try and have us believe and I’d like to know how much interest exactly was earn while they were take your time settling with claimants and paying them

    $438.xx in WI today. I did visit doctor regarding this, did not submit documentation.

    The statement accompanying the check states….”Please be advised that the value of all valid claims exceeded the amount available for distribution. As a result, your payment has been reduced on a proportionate basis, but can be no lower than the minimum value of $20.00.”
