
The Washington State Auditor’s Office (SAO) has agreed to pay more than $3 million to resolve claims it failed to prevent a 2020 data breach.
The Washington State Auditor’s Office data breach class action settlement benefits individuals residing in the United States to whom SAO or its authorized representative provided a notice concerning the December 2020 data security incident.
According to the data breach class action lawsuit, the Washington State Auditor’s Office failed to implement reasonable cybersecurity measures that could have prevented the 2020 data breach. As a result of the breach, the plaintiffs and other consumers were allegedly at risk for identity theft and fraud.
The Washington State Auditor’s Office is responsible for auditing the finances and performance of Washington state agencies, local governments, tribes and other entities.
The Washington State Auditor’s Office has not admitted any wrongdoing but agreed to a class action settlement of $3,085,152.73 to resolve the allegations.
Under the terms of the Washington State Auditor’s Office settlement, class members can receive compensation for out-of-pocket losses related to the data breach.
Class members can claim up to $5,000 for documented losses, such as identity theft, postage, bank fees, professional fees, mileage, travel-related charges, communication charges and more. Class members can also claim up to three hours of lost time at a rate of $30 per hour for a maximum reimbursement of $90.
Instead of claiming out-of-pocket losses, class members can elect to receive an alternative compensation payment. These payments will be calculated based on the number of valid claims filed and the amount of the settlement fund remaining after documented monetary loss payments and cash awards are deducted.
The deadline for exclusion and objection is Sept. 24, 2025.
The final approval hearing for the Washington State Auditor data breach class action settlement is scheduled for Oct. 28, 2025.
To receive settlement benefits, class members must submit a valid claim form by Oct. 24, 2025.
Who’s Eligible
Individuals who received a data breach notification from the Washington State Auditor’s Office or its authorized representative regarding a December 2020 data security incident.
Potential Award
Up to $5,000 in out-of-pocket losses, plus $90 in lost time, or an alternative cash award.
Proof of Purchase
Documentation of losses, such as bank statements, phone records, invoices and receipts.
