The Federal Trade Commission (FTC) will send 5,588 checks totaling more than $2.6 million to businesses that were wrongly charged expensive termination fees by First American Payment Systems. 

The First American Payment Systems settlement benefits businesses that were enrolled with First American Payment Systems between June 2017 and April 2020 and charged an early termination fee.

According to the FTC, First American Payment Systems made false claims regarding its fees and costs, thus deceiving businesses and later charging expensive termination fees. The FTC also argued that the payment company targeted merchants with limited English proficiencies.

First American Payment Systems is a payment processing company that integrates, sells and accepts payments.

Under a federal court order, the defendants were ordered to pay $4.9 million and to stop deceptive practices. $2.6 million of this settlement is being returned directly to customers.

According to the court order’s terms, claimants will receive a payment based on the amount paid in fees and the number of claims filed. No payment estimates are available at this time.

There is no exclusion or objection deadline for the First American Payment Systems settlement.

The federal court order was entered on July 19, 2022.

Consumers must submit a valid claim form by May 7, 2025 to receive an FTC refund.
