1st Auto & Casualty Insurance Co. agreed to a $788,000 class action lawsuit settlement to resolve claims it failed to include sales tax in total-loss payments to Missouri policyholders.

The settlement benefits Missouri policyholders insured by 1st Auto & Casualty Insurance Co. who submitted a physical damage claim for a vehicle that resulted in a total loss claim payment between Oct. 18, 2012, and May 5, 2022.

According to the sales tax class action lawsuit, 1st Auto failed to compensate Missouri policyholders for sales tax when paying out total loss claims. As a result, policyholders were allegedly paid hundreds or thousands of dollars less than they should have been. 

1st Auto & Casualty is a subsidiary of Wisconsin Reinsurance Corp. that provides auto, farm and personal liability insurance. 

The company hasn’t admitted any wrongdoing but agreed to pay $788,220 to resolve the sales tax class action lawsuit.

Under the terms of the settlement, class members can receive a cash payment equal to sales tax on the adjusted vehicle value at the time of their claim. Payments will vary depending on claim details. 

The deadline for exclusion and objection is Aug. 11, 2023.

The final approval hearing for the class action lawsuit settlement is scheduled for Sept. 12, 2023.

In order to receive a settlement payment, class members must submit a valid claim form by Sept. 27, 2023.
