An $18.5 million East River Medical Imaging settlement resolves claims the medical provider failed to protect patient information from a 2023 data breach.
The settlement benefits individuals whose personal information the East River Medical Imaging data breach was compromised and disclosed in November 2023, including those who received a data breach notification regarding the incident.
Between August and September 2023, hackers allegedly accessed East River Medical Imaging’s computer systems and stole sensitive information, such as insurance information and Social Security numbers. Plaintiffs in the data breach class action lawsuit argue East River Medical Imaging could have prevented or mitigated this cyberattack by implementing reasonable digital security measures.
East River Medical Imaging is a radiology center with locations in New York City and the surrounding areas.
East River Medical Imaging hasn’t admitted any wrongdoing but agreed to pay $18.5 million to resolve the data breach class action lawsuit.
Under the terms of the East River Medical Imaging settlement, class members can choose between two payment options: expense reimbursement or a pro rata cash payment.
The expense reimbursement option offers up to $7,500 in documented losses related to the data breach. This may include bank fees, credit costs, professional services, communication charges, travel expenses, damages from fraud or identity theft and other losses.
Class members without documented expenses or those who do not wish to claim reimbursement can instead claim a pro rata cash payment. These payments will vary depending on the number of valid claims filed and the amount left in the settlement fund after other benefits are paid.
Regardless of which payment option they choose, all class members can receive free three-bureau credit monitoring and identity theft services, including $1 million in insurance coverage.
The deadline for exclusion and objection was Aug. 23, 2024.
The final approval hearing for the settlement is scheduled for Oct. 22, 2024.
To receive East River Medical Imaging settlement benefits, class members must submit a valid claim form by Oct. 22, 2024.
