Talcott Resolution Life & Annuity Insurance Co., previously known as Hartford Life and Annuity Insurance Company, and Talcott Resolution Life Insurance Co. agreed to an $11 million class action settlement to resolve claims they charged excessive premium tax on life insurance policies.

The Hartford settlement benefits individuals who own or owned a universal life or variable universal life insurance policy issued by Talcott Resolution Life & Annuity Insurance or Talcott Resolution Life Insurance and whose policy stated that the premium tax charge depends on their state (or municipality) of residence, and that tax rate will change if their address changes or if the state tax rate changes.

The settlement class includes policyholders whose policies were subject to an “address change issue” in which their address of record changed for their policy after their policy was issued, and the insurer did not properly adjust the premium tax rate to match their new state, or a “tax rate issue” in which their policy was associated with Arizona, Connecticut, the District of Columbia, Idaho, Illinois, Indiana, Iowa, Kentucky, Michigan, Minnesota, Nebraska, New Hampshire, New York, Ohio, Oregon, South Carolina or Wyoming, and the insurer allegedly applied an allegedly incorrect premium tax rate.

The settlement also covers policyholders who paid premiums during specific time periods, which vary by state and issue.

According to a class action lawsuit, Talcott Resolution Life & Annuity Insurance and Talcott Resolution Life Insurance charged excessive premium tax charges on life insurance policies when policyholders changed their state of residence and failed to properly adjust premium tax rates when state tax laws changed and applied incorrect tax rates in certain states.

Talcott Resolution Life & Annuity Insurance is a financial services company responsible for holding and servicing active policies on behalf of the Talcott Financial Group.

The Talcott life insurance companies have not admitted any wrongdoing but agreed to an $11 million class action settlement to resolve all class action allegations.

Under the terms of the Hartford settlement, class members can receive a cash payment based on the type of claim they have. Class members with “address change” and “tax rate” claims will receive 100% of any alleged overcharges for these claims, less a proportional share of fees, expenses and awards associated with those acknowledged claims.

Class members with “retaliatory tax rate” claims will receive a lower percentage of the alleged overcharges for these disputed claims. Class members with multiple types of claims will receive a combined payment for all applicable claims.

The deadline for exclusion and objection is Aug. 26, 2026.

The final approval hearing for the class action settlement is scheduled for Sept. 24, 2026.

No claim form is required to benefit from the Hartford settlement. Class members who do not exclude themselves will automatically receive a settlement check in the mail if they are entitled to one.


Who’s Eligible

The class action settlement benefits individuals who own or owned a universal or variable universal life insurance policy issued by Talcott Resolution Life & Annuity Insurance or Talcott Resolution Life Insurance with policy terms stating the premium tax charge depends on the policyholder’s state or municipality of residence.

Eligible policies must have been affected by an alleged address change issue, in which the premium tax rate was not updated after a change of address, or a tax rate issue involving policies associated with Arizona, Connecticut, the District of Columbia, Idaho, Illinois, Indiana, Iowa, Kentucky, Michigan, Minnesota, Nebraska, New Hampshire, New York, Ohio, Oregon, South Carolina or Wyoming.

Policyholders also must have paid premiums during qualifying time periods, which vary by state and issue.
