
Kaiser Foundation Health Plan Inc. agreed to a $10.5 million class action lawsuit settlement to resolve claims it violated the federal Telephone Consumer Protection Act (TCPA) and Florida’s Telephone Solicitation Act (FTSA) by sending unsolicited marketing text messages to consumers.
The Kaiser TCPA FTSA settlement benefits a nationwide class of consumers who received more than one text message from Kaiser Foundation Health Plan from Jan. 21, 2021, through Aug. 20, 2025, after opting out by replying “stop” or with a similar instruction and a class of Florida consumers who received more than one text message after texting “stop” at least 15 days before the messages were sent.
Kaiser Permanente is a health care services company headquartered in Oakland, California.
The class action lawsuit alleged that Kaiser’s unsolicited telemarketing texts violated the TCPA and FTSA.
Kaiser has not admitted any wrongdoing but agreed to a $10.5 million class action settlement to resolve alleged TCPA and FTSA violations.
Under the terms of the Kaiser class action settlement, class members who received one or more qualifying text messages can receive up to $75 per message.
If the number of approved claims exceeds the settlement fund, payments may be reduced on a pro rata basis. Exact pro rata payments will vary depending on the number of messages received by each class member.
The deadline for exclusion and objection is Dec. 29, 2025.
The final approval hearing for the Kaiser TCPA FTSA settlement is scheduled for Jan. 28, 2026.
To receive settlement benefits, class members must submit a valid claim form by Feb. 12, 2026.
