Manufactured home class action lawsuit overview: 

  • Who: Carla Hajek and Gregory Hammerlund filed a class action lawsuit against a group of manufactured home community owners and Datacomp, a provider of manufactured and mobile home data. 
  • Why: Hajek and Hammerlund claim the manufactured home community owners conspired with a mobile home data valuator, Datacomp, to fix, maintain and/or stabilize lot rental prices for their residences. 
  • Where: The class action lawsuit was filed in Illinois federal court. 

A group of manufactured home community owners conspired alongside a mobile home data valuator to fix, raise, maintain and/or stabilize lot rental prices for the residences, a new class action lawsuit alleges. 

Plaintiffs Carla Hajek and Gregory Hammerlund claim residents of manufactured homes are “being overcharged for what used to be affordable housing,” thanks to the companies alleged conspiracy. 

Hajek and Hammerlund named a number of owners of manufactured home communities in their complaint, as well as Datacomp, a provider of manufactured and mobile home data the defendants use. 

“After acquiring the communities, these buyers have implemented steep, annual rent increases on their manufactured home lots, which have caused significant burdens on manufactured home residents,” the manufactured home class action states. 

Hajek and Hammerlund want to represent a nationwide class of all persons or entities who paid rent directly for a manufactured home in a community included in a JLT Market Report from between Aug. 31, 2019, and the present.

Community owners coordinate to reduce, eliminate competition, class action says

Hajek and Hammerlund claim the manufactured home community owners coordinate with each other “to increase manufactured home lot rents systematically and unlawfully by purchasing and using market reports published by Defendant Datacomp.” 

The plaintiffs claim they do this via reports known as JLT Market Reports, which they allege allow the community owners to “reduce or eliminate competition amongst themselves on price, services and quality for manufactured home lots,” according to the manufactured home class action. 

“The consequence is that two of society’s most vulnerable groups—the elderly and low-income earners—face considerable financial pressures. Some residents are facing evictions,” the class action states. 

Hajek and Hammerlund claim the community owners and Datacomp violate the Sherman Act. They demand a jury trial and request injunctive relief along with an award of treble damages for themselves and all class members. 

In another case involving home prices, a consumer filed a class action lawsuit against Zillow in 2021, arguing the company failed to disclose critical information to investors in regard to its Zillow Offers side of the business.

    Green Acres Mobile Home Park in Loveland Ohio has been illegal raising the rent here and charging fees for unnecessary things.shes the worst management you can ever find.oh and she’s lived here for 4 years but yet she has a place in Cincinnati ohio and votes in Cincinnati ohio. not clermont county Ohio.

    Same thing here in Clermont County Ohio at the Green Acres Mobile Home Park in Loveland Ohio. she’s using that data rate app.also i was the SEC who blue the Gemstone Real Estate investment company of investment fraud and commission fraud. they had to pay 3.3 million in fines and more.ive been Harassed by her putting violation notices every day 5 in one month.she violated contract by coming on to the property I rented for 16 years and cut down two of my trees in my yard just so she can move a trailer on the next lot
    no notice no nothing. and all she said is she can do what ever she wants it private land. haha if you rent the property, the have to by law give you a 24 hour notice if emergency then there allowed. but it wasn’t no emergency they just cut my trees and ripped up and busted my blocks I had outlined my lot.

    Same here in Ohio. Continental Communities raises lot rent every year. Along with water and sewer charges. And, this year, they’ve added trash @ $25 @ month. I’m sure they’ll be raising that price as well .

    The Saratoga Group/SG Communities is another huge mobile home investor who has raised rent by more than 50% since the purchase of our MHP. Has evicted ones who own so they can bring in illegals for his construction crews to lessen the cost of his so called renovations. I was harassed, retaliated against, discriminated against. Had the park manager tresspass and stole my car refusing to return for over 30 days. Said they didn’t have to honor lease we had signed with previous owners. Park manager repeatedly told lies. I was taken to court several times in less than a year and each time it was dismissed things only had gotten worse. Park manager asked for a different judge to handle our case and eventually had me evicted, was served a writ and when the 3 day came for me to be out I was still in process of moving my belongings but she had already hired a crew who entered the mobile home i putxhased 15 years ago and had my thingsnthrown into dumpsteres and taken to the dump without any court telling her she could enter my home and dispose of my things, she evem removed all my appliances as if the home was not mine. The investor is Sam Hales he also has several videos on you-tube explaining the tips and tricks to be profitable when you purchase a mobile home park. When looking for mobile home parks to purchase he also looks for states that lack in protecting tenants which allows him to do as he pleases.

    Kingsley Management Corporation, Provo, Utah, is the owner of my manufactured home community in Illinois. Beginning with the January 1, 2025, rent increase, they rolled nearly $1.7 million dollars of infrastructure upgrades into the base site rent, in addition to raising the base site rent. This increase was around 14%. Adding insult to injury, since the charges for the upgrades has been rolled into the base lot rent, it is a forever charge, so KMC will be profiting from the charges for as long as they own the property. Additionally, the upgrades only impacted 1/4 of the homes within the MHC. I’d like to see someone write about this. Please feel free to contact me.

      We bought in March 2024 , the price for our lot was raised by $700 in the first year . How do we join this?

    Am sick over paying $1050 a month for a small lottery for rent!
    We payed for our home completely without a mortgage but we are all being overcharged for the lot our home is on!

      I unfortunately bought my home in a community owned by Contentsl Communities, in Michigan. They continue to raise the lot rent yearly.stating operations charging more for services. In reality these services are performed by sister companies they created. They are charging themselves more to justify the increases so they can continue to make more . People in these communities are stuck like cash cows and these corporations will milk us for everything we’ve got and then they’ll take our homes too after those of us on fixed incomes can no longer afford the rents.

    This practice has been going on every year since 1988 when I moved to Fla. Each January a price hike with nothing added or additional service. Along with the higher tax bill …on movable homes ??? Why?
