Walgreens Gift Cards Class Action Lawsuit Overview: 

  • Who: Jacques Calixte filed a class action lawsuit against Walgreen Co. 
  • Why: Calixte claims Walgreens fails to adequately safeguard gift cards it sells and/or manufactures from being compromised by unauthorized third parties. 
  • Where: The class action lawsuit was filed in Illinois federal court.

Walgreen Co. manufactured and/or sold gift cards susceptible to being improperly accessed and used by third parties, a new class action lawsuit alleges. 

Plaintiff Jacques Calixte claims Walgreens failed to both implement safeguards for its gift cards and to inform consumers their gift cards were not adequately protected against theft. 

Calixte says he purchased three Vanilla Visa gift cards worth $150 each at a Walgreens in Florida in November 2020 but “misplaced them” and so did not immediately use them. 

When checking the balance on the gift cards in March 2022, Calixte argues only one of the gift cards still had its full $150 value, with the other two having values of $0 and $5. 

Calixte claims transactions were made on the gift cards that he did not, and could not, have placed. 

Walgreens had failed to “adequately train” and require its employees to consistently inspect the gift cards it was selling, including to check for “evidence of tampering, such as crooked security tape, scrape marks from tape removal, non-factory security tape and tape residue edge marks from original security tape,” the class action lawsuit alleges. 

Walgreens Class Action Claims Company Failed To Warn Consumers About Gift Card Theft

Calixte argues further that Walgreens failed to warn consumers that its gift cards could be tampered with or compromised and had not taken reasonable measures to prevent it from happening. 

“Defendant failed to disclose that its Gift Card policies and security practices were inadequate to safeguard Gift Cards against theft,” the class action lawsuit states. 

Due to the gift cards allegedly not being properly secure, Calixte claims they were worth “materially less” than the value Walgreen’s represented them to be and were thus sold at a higher price at the expense of consumers. 

Calixte claims Walgreens is guilty of unjust enrichment, fraud, breach of contract and negligent representation and in violation of the Magnuson Moss Warranty Act, multiple state consumer fraud acts and the Illinois Consumer Fraud and Deceptive Business Practices Act

Calixte wants to represent a Florida class and multi-state class of consumers who purchased gift cards at Walgreens. 

Plaintiff is demanding a jury trial and requesting injunctive relief along with monetary, statutory and/or punitive damages for himself and all class members. 

A separate class action lawsuit was filed against Walgreens last month over allegations the company’s pharmacy overcharged health plan providers on drug reimbursement claims.

    “By submitting this comment you agree to be contacted by an attorney-law firm to discuss the details of your case at no charge if qualified”. I hope this is true because I need help. On 12-20-23 Walgreens (5487 Wilshire Blvd Los Angeles CA 90036) “sold” me $200.00 of fraudulent-irredeemable Apple gift cards. The redemption codes on the back of both cards were whited out thus rendering both useless. When presented with evidence (receipts cards) management refused to refund me the money. Management even went so far as to blame shift onto me and random individuals that entered the store. Point. Walgreens is the company that sold me the cards, therefore, Walgreens alone is responsible and needs to be held accountable. No one else. This whole ordeal has left me feeling extremely upset embarrassed victimized and violated. Violated in a way no different from being robbed of $200.00 off the streets. This is not okay. This cannot possibly be legal. I’d like to take action, but, I don’t know how to go about doing so? LMK thanks
