Spartan Race participants may be able to benefit from a class action settlement related to racer insurance fees.

The Class includes anyone in the United States who, based on Spartan’s records, paid a $14 “Racer Insurance Fee” or “Insurance Fee” in connection with any race organized and sponsored by Spartan between Feb. 26, 2016, and Dec. 31, 2020, inclusive.

The plaintiff in a class action lawsuit had alleged Spartan profited by charging and retaining most of the money from the racer insurance fees, in violation of Florida’s Deceptive and Unfair Trade Practices Act and Massachusetts’ Consumer Protection Law.

Class Members in the Spartan Race insurance settlement will have a choice of benefits.

The first option is a free four-month Spartan+ Membership Program membership.

The membership includes the highest level of access to all available audio, video, and other digital content, a 20 percent discount and free shipping and handling for any merchandise purchased on the Spartan website, free event photo downloads and access to other premium online content.

This membership typically costs $85 per year.

The second option available to Class Members is a $5 voucher usable on any non-sale Spartan merchandise on the Spartan website for each time they paid a racer insurance fee.

No Class Member may receive more than four vouchers, and the vouchers may not be combined with any other promotions.

The vouchers will be transferable, stackable, and valid for two years from the date they are issued.

In addition to this relief, Spartan alsos has agreed to change the language it uses on its marketing and sales materials, relevant screens during the online registration process, and in other places, to read: “The Administrative, Insurance, and Management Fee covers a number of different costs involved in Spartan events, including administrative and management costs, insurance costs and expenses for related risk management and safety measures. This fee is not a direct pass-through of third-party costs to the racer and may include revenues to Spartan.” 

Eligible Class Members have been sent an email containing a password that is needed to access the online claim form.

Anyone wishing to object to or exclude themselves from the Spartan Race insurance settlement must do so by April 7, 2021.

A final hearing is scheduled for May 7, 2021.

Who’s Eligible
