PALMco Power agreed to pay over $1.89 million as part of a energy rate settlement to resolve claims it overcharges Massachusetts customers for electricity.
The settlement benefits individuals who enrolled with PALMco to receive electricity at a Massachusetts property between Aug. 1, 2014, and Sept. 13, 2017, and who were charged a variable electricity rate.
PALMco is an electricity and gas company that provides utility services to Connecticut, Illinois, New Jersey, Maryland, Massachusetts, Ohio and Pennsylvania. PALMco Power MA is the company’s Massachusetts-based subsidiary.Â
In 2019, PALMco was hit with a class action lawsuit from Massachusetts customers challenging the energy rates the utility provider charges. According to the customers, PALMco did not charge customers based on market-related factors or prevailing market rates. This allegedly caused customers to overpay for their electricity services.
PALMco denies these allegations. The company argues its rates were adequately disclosed to customers and related to electric service market factors.Â
PALMco faced similar allegations from the New Jersey attorney general, claiming the company used harassing marketing tactics to gain customers — only to overcharge for electricity rates despite promises to consumers. The company agreed to pay $4.5 million to resolve these claims.
A similar settlement has been reached in the Massachusetts electricity rate class action lawsuit. Although PALMco hasn’t admitted any wrongdoing, it agreed to resolve these allegations with a $1.98 million settlement deal.
Under the terms of the PALMco Power settlement, class members can receive a proportionate share of the settlement fund based on the amount of electricity they paid for.Â
According to the settlement website, class members can receive $0.00784 for every kilowatt-hour they paid PALMco for. Exact payment amounts will not be available until all claims are filed.
The deadline for exclusion and objection is Sept. 19, 2022.Â
The final approval hearing for the PALMco Power settlement is scheduled for Oct. 19, 2022.
In order to receive a payment, class members must submit a valid claim form by Oct. 19, 2022.
