A $10 million FCTI 7-Eleven settlement resolves claims that the ATM company charged excessive fees at 7-Eleven stores.
The settlement benefits two classes: a New York class and a nationwide class.
The New York class includes individuals whom FCTI assessed more than one ATM fee for a balance inquiry during a single visit to an FCTI ATM in New York between May 1, 2018, and Nov. 16, 2021, using a card issued by New York Community Bank, KeyBank, Webster Bank, M&T Bank, TD Bank, Community Bank of New York, Citizens Bank, NBT Bank, Bank of America or Wells Fargo.
The nationwide class benefits individuals whom FCTI assessed more than one ATM fee for a balance inquiry during a single visit to an FCTI ATM between May 1, 2018, and Nov. 16, 2021.
Plaintiffs in the class action lawsuit claim that FCTI charged double out-of-network ATM fees on single balance inquiry transactions. These fees allegedly stemmed from FCTI’s system improperly transmitting two balance inquiry requests to consumer banks.
FTCI is an ATM provider that operates the ATMs found in 7-Eleven stores.
FCTI hasn’t admitted any wrongdoing but agreed to pay $10 million to resolve the class action lawsuit.
Under the terms of the FCTI 7-Eleven settlement, New York class members can receive $27 and nationwide class members can receive up to $15. Additional funds remaining in the settlement after initial payments may be distributed amongst all class members on a pro rata basis.
The deadline for exclusion and objection is Nov. 20, 2024.
The final approval hearing for the settlement is scheduled for Dec. 20, 2024.
To receive FCTI 7-Eleven settlement benefits, class members must submit a valid claim form by Oct. 22, 2024.
