Dollar General class action claims gas stations give change in fuel cards

Dollar General gas stations class action lawsuit overview: 

• Who: Cecil Burns filed a class action lawsuit against Dollar General Corporation, DG Promotions Inc. and DG Retail LLC. 
• Why: Burns claims Dollar General denies cash change to consumers who pay for fuel in cash and, instead, puts any change onto a Dollar General fuel card that can only be used for purchases at its stores. 
• Where: The Dollar General class action lawsuit was filed in Tennessee federal court. 

Dollar General maintains a policy that denies customers the right to receive change in cash, a new class action lawsuit alleges. 

Plaintiff Cecil Burns’ class action lawsuit claims Dollar General, rather than providing change in cash to customers who pay with cash, opts to place change onto a Dollar General fuel card that can only be used to purchase products at its stores. 

“Given that the fuel cards can only be used at Defendants’ locations, Defendants have unjustly enriched themselves to the detriment of Plaintiff and the Class,” the Dollar General class action says. 

Burns wants to represent a nationwide class of consumers who have used cash to purchase gasoline at a Dollar General location and had their change placed on a Dollar General fuel card. 

Dollar General does not tell customers they won’t receive cash change, class action claims

Burns claims Dollar General carries out its alleged “scheme” to only provide change on Dollar General fuel cards without first disclosing it to consumers. 

“Without any disclosure to their customers, Defendants place the amount of cash initially paid by a customer onto a fuel card,” the Dollar General class action says. 

Burns claims Dollar General is guilty of conversion and unjust enrichment. He demands a jury trial and requests injunctive and declaratory relief and an award of compensatory and punitive damages for himself and all class members. 

A consumer filed a separate class action lawsuit against Dollar General last year over claims the company regularly charged more for items at the cash register than what their advertised price was on the shelf.
