Consumers filed a class action lawsuit against Best Buy, alleging the electronics retailer engaged in a false discount advertising scheme for its TVs and major appliances since at least February 2023.
According to the Best Buy class action lawsuit filed Jan. 6, the retailer advertises perpetual or near-perpetual discounts on its products both in its retail stores and on its website. These discounts are based on reference prices Best Buy represents as its regular and normal prices, the plaintiffs say. The claim Best Buy rarely, if ever, offers the products at their advertised “normal” reference price.
The class action lawsuit argues Best Buy’s deceptive pricing scheme is intended to trick consumers into believing they are getting a special bargain. As a result, consumers are induced to purchase products they might not have bought otherwise, the lawsuit says.
The plaintiffs claim Best Buy’s false discount advertising violates California’s Consumers Legal Remedies Act, False Advertising Law and Unfair Competition Law.
False discounts cause consumers to pay more, class action alleges
As a result of Best Buy’s false discount advertising, consumers pay more for products than they would have if the discounts were genuine, the class action says. The plaintiffs argue they did not receive the benefits of the discounts Best Buy promised them and that the products were not worth the amount Best Buy represented to them.
The Best Buy class action lawsuit seeks to represent a class of California consumers who purchased one or more products advertised with a discount since February 2023. The plaintiffs seek restitution and/or disgorgement for themselves and for each of the California class members. They also seek public injunctive relief to stop Best Buy from engaging in the alleged unlawful false advertising scheme.
Meanwhile, consumers recently hit Hobby Lobby with a class action lawsuit alleging it deceives consumers by routinely advertising significant never-ending discounts on certain products.
