Cerner Corp. retirement plan participants may be eligible to benefit from a $4.05 million settlement.
Anyone who was a participant in or a beneficiary of the Cerner Corp. Foundations Retirement Plan at any point between Jan. 21, 2014, and March 5, 2021, is considered a Class Member.
Class Members are not required to file a claim form in order to benefit from the settlement and will automatically receive their benefits after the Court grants approval.
However, Class Members who wish to receive their payment through a rollover to a qualified retirement account, rather than by check, must submit a Former Participant Rollover Form.
Plaintiffs in a class action lawsuit had alleged Cerner violated the federal Employee Retirement Income Security Act (ERISA) by offering unduly expensive investment options and paying excessive plan administration fees.
ERISA was enacted to protect employees who pay into employer-sponsored retirement accounts, such as 401(k) plans, and covers some welfare benefit plans, such as long-term disability insurance.
Cerner offers revenue cycle management, analytics, and other information technology services for health care clients, according to the company’s website. Cerner has more than 27,000 associates.
While Cerner denies all claims of wrongdoing and denies any liability, it has agreed to the settlement to avoid the expense and risk of ongoing litigation.
Class Members will be eligible for a proportional payment based on a settlement allocation score calculated by the settlement administrator. This calculation will take into account the Class Member’s quarter-ending account balance and other factors.
If the settlement administrator calculates a Class Member’s payment amount at less than $2, the Class Member will not receive a share of the settlement fund.

Payments from this settlement may have certain tax consequences, and Class Members should consult their tax advisor.
Class Members will receive their payment or deposit no later than 40 days after the settlement is approved and/or any appeals have been resolved in favor of the settlement.
A final approval hearing for the Cerner settlement is set for July 22, 2021.
The deadline to object to the settlement is July 1, 2021.
