A federal COVID-19 vaccine mandate put in place for military service members, federal employees, and federal civilian contractors violates their constitutional rights, a new class action lawsuit alleges.
Lead plaintiff Navy Seal 1 claims the COVID-19 vaccine mandate put in place by President Joe Biden violates Class Members religious beliefs and is an insult to their service to the country.
Navy Seal 1 wants to represent a Class of military service members, civilian federal employees, and civilian federal contractors who have been denied religious exemption from taking the COVID-19 vaccine.
The plaintiff says his request to be religiously exempt from taking the COVID-19 vaccine was denied and that he was subsequently removed from his position in the US Navy.
The federal COVID-19 vaccine mandate stipulates that members of the US Navy and US Marines have until Nov. 28 to be fully vaccinated, according to the class action lawsuit.
Members of the US Army and US Air Force, meanwhile, have until Dec. 15 to be fully vaccinated, while members of the US Coast Guard and civilian federal employees and contractors have until Nov. 22, according to the class action lawsuit.
Navy Seal Claims Biden’s Vaccine Mandate Takes Away the ‘Very Constitutional Rights’ Service Members Seek to Protect
Navy Seal 1 claims the vaccine mandate seeks to take away the very constitutional rights they and their fellow service members have taken an oath to protect.
“For that ultimate sacrifice in defense of the Constitution and our freedoms, Defendants are threatening these military heroes with dishonorable discharge for even requesting a religious exemption from the COVID-19 shots,” the class action lawsuit states.
Federal employees and military service members who aren’t given an exemption and don’t abide by the COVID-19 vaccine mandate face discipline including the potential for a dishonorable discharge or court martial, according to the class action lawsuit.
Navy Seal 1 claims a dishonorable discharge is the worst punishment a military service member can face and would be an affront to their services and the sacrifices they have made.
“Dishonorable discharge is worse than criminal conviction for these service members because it is a badge of disgrace that follows them for the rest of their lives,” states the class action lawsuit states.
Navy Seal 1 claims the federal COVID-19 vaccine mandate violates the Federal Food, Drug, and Cosmetic Act, the First Amendment to the United States Constitution, and the Religious Freedom Restoration Act.
Navy Seal 1 is requesting a temporary restraining order keeping the defendants from enforcing the federal COVID-19 vaccine mandate and for defendants to begin accepting all religious exemption requests.
A similar class action lawsuit was filed last month by two military service members who argued that active-duty service members who have gotten COVID-19 and recovered should be exempt from having to take the vaccine.

Where’s our constitutional rights?
I have worked for the government for 9 years as a DHS employee. I’m working on submitting my religious accommodation request and I have been looking for class action lawsuits to join on the vaccine mandate. How do I join this lawsuit?
Member of the Army National Guard in a very conservative state, however, I have heard many of our top leaders at the state level joking about and making blanket statements that they will be denying all religious accommodation requests. Over 1000 have already been denied (approx 20% of the force). Why are antibodies irrelevant? Why is frequent testing inadequate? Why have the mandates taken a political turn?
I am a DoD civilian employee for 38 yrs supporting the warfighter in the financial area, currently with Navy. I am required to be fully vaccinated by 22 NOV although I have been teleworking full time since March 2020. I believe it is my constitutional right to decide what is put into my body and in my opinion this ‘jab’ has not been studied long enough to know the long term effects. I had COVID19 and recovered at home leaving me with natural antibodies. I think it should be within my rights to get tested for antibodies and choose to test and choose to not be vaccinated. That is not an option under this mandate.
I am a “Temporary Employee” who has worked for FEMA for over 30 years. I face being terminated if I refuse the so-called vaccine. I believe a true vaccine fully protects a person from contracting a disease. These gene therapy treatments that they are calling “vaccine’s” do not do that. The Agency says I have to be “Fully Vaccinated from Covid” by Nov. 22nd but they can’t tell me how to be “Fully Vaccinated” only that I have to take a drug approved for emergency use that does not prevent me from contracting or spreading the disease.
Thank you for your service, to all the service members. I got the shot and regret doing so. I’ve had different pain in my body and had a silent heart attack only 3 days after getting the second shot, and had to have a stint in my rca. What’s in this shot that’s so important for everyone to get it?
I truly do appreciate all of our Service Men and Service Women. I recognize how invaluable they are to protecting this country and I know that many of them have surrendered their lives for other’s freedom. However, it’s not a constitutional right to infect others with a deadly virus. I understand that alternatives should be made available such as frequent testing and ensuring all mitigating factors are being regulated (masks, social distancing, etc…). It’s unfortunate that mandates are necessary due to those who are dishonest and reckless during this pandemic.

Have you seen how many of those being forced to vaccinate already have antibodies as they have already recovered from COVID? Have you seen the other countries studies of MILLIONS of survivors with equal or better immunity to the original strain and new variations? Have you seen the other countries giving passports to COVID survivors after being tested for antibodies? Have you seen the increasing numbers of side effects, especially heart related issues in young males (who make up the majority of our military and emergency responders)? Personally as an unvaccinated First Responder, I am tested biweekly and I have yet to test positive no matter my exposure level in over a year after surviving COVID. Meanwhile, the last time I did get a vaccine, within a couple weeks, I was in a hospital with pericarditis. Given my young, healthy state, past medical history, and MANY negative tests, I think it should be within my rights to get tested for antibodies, continue biweekly testing, and choose to not be vaccinated. That is not an option under this mandate. Meanwhile, vaccinated individuals are not being tested, have been proven to be able to be reinfected, and even worse, have been shown to more often be asymptomatic resulting in them unknowingly spreading the virus.

It is supposed to protect you, or are you failing to buy into that lie now? Ask Colin Powell how well the jab protected him from Covid. The constitutional right comes into play when the contents and long-term effects of this ‘vaccine’ comes into question. Why did the definition of vaccine have to be changed so as to include the Covid vaccine? It’s NOT a vaccine, and who really knows what it is? Why is the government so intent on getting everyone jabbed, despite the overwhelming evidence that natural immunity is far better? So many questions… I have had Covid, and the Delta variant myself. So has my wife, and my in-laws who are in their 80’s. We all survived the 2-week mild flu symptoms. 99% do as well, while the jab is supposed to provide 99% protection. Hmmm… same chances with or without it. So WHY is it being pushed so hard then??? What is REALLY in that shot? I have to thank all the fools who have gotten it. THEY will be the ones who show the rest of us what the long-term effects actually are.

The fact the the federal government “will not accept previous covid infection OR POSITIVE ANTIBODY tests” is all you need to know…this mandate has nothing to do with science, health of the public. Didn’t Jen Psaki just get infected with covid???? Wasn’t she “vaccinated”??? So how the F did she get it if she got the shot????
I totally disagree with Christina. There is no live virus that’s injected in anyone. This a mRNA shot which means that it’s a type of protein messenger that sends a message to the RNA which stimulates the production anti-bodies in your body to fight it. There’s no live or dead virus involved in the process at all. I had 3 doses of the Pfizer vaccine and had nothing more than a little soreness. And people in the military gave up their rights to refuse any shot or vaccinations that higher authorities deem in the best interests to maintain mission readiness. You gave up a lot of your rights and freedoms when you join the military or accept government employment. If you can’t abide with it, your service is no longer required if you can’t follow orders and you are released for the good of the service.
