Patients who may have been exposed to inconsistent dental tool sterilization protocols at Nova Southeastern University may be eligible to benefit from a $5.456 million class action settlement.

The Class is made up of 1,152 patients who received from Linda Niessen, dean and professor of Nova Southeastern University’s College of Dental Medicine, a letter informing them they may have been exposed to inconsistencies in prescribed sterilization protocols while a patient at NSU’s PostGraduate Orthodontic Clinic at 3200 S. University Drive in Davie, Florida, between July 2015 and February 2018 and offering a screening blood test, and who obtained a screening blood test the results of which were negative for any viral disease from such exposure.

The class action lawsuit, filed in December 2018, had argued dentist residents at the Nova Southeastern clinic failed to follow U.S. Centers for Disease Control and Prevention (CDC) guidelines requiring dental and orthodontic equipment to be sterilized with heat.

The Nova Southeastern College of Dental Medicine was the first private dental college to be established in Florida, according to the school’s website. The college provides doctoral, postdoctoral, and international curricula.

Nova Southeastern has not admitted to any wrongdoing, but has agreed to a settlement.

After attorneys’ fees and other expenses are paid, the remaining amount in the settlement fund will be distributed to Class Members.

Each Nova Southeastern dental tool sterilization settlement Class Member who submits a complete, valid, and timely claim form will receive a $3,000 payment.

If the Class Member is a minor, their parent or guardian must provide and certify their information.

Any remaining in the fund and not paid, or from uncashed checks, if any, up to $350,000 will be paid to a charitable trust. Any amount in excess of $350,000 will revert to Nova Southeastern.

A final fairness hearing was held March 2, 2021.

The deadline to request to be excluded from or to object to the Nova Southeastern dental tool sterilization settlement has passed.

Claims must be postmarked by July 21, 2021.

  • Each Nova Southeastern settlement Class Member who submits a complete, valid, and timely claim form will receive a $3,000 payment.
