Lonely old woman looking out of windowA woman has filed a nursing home lawsuit, claiming that her mother was neglected for weeks before her death in an Oregon nursing home.

Plaintiff Laurie J. says that her mother, Betty W., was a resident at the Linda Vista Nursing and Rehab Center in Ashland, Ore. until her death in May 2017 at the age of 85. Laurie claims that staff at Linda Vista did not properly care for Betty, neglecting her and failing to give her the pain medications she was prescribed.

Unfortunately, this is not the only case like this. Two other nursing home companies made headlines recently for allegedly neglecting residents. They have both been the subject of nursing home lawsuits.

According to the Columbus Dispatch, an Ohio woman claims that her brother’s death was caused by improper care at his nursing home. She filed a wrongful death lawsuit against the company, Whetstone Gardens and Care Center. 

In another case, the large health company Vanguard Healthcare LLC has agreed to pay settlements to the federal government and the state of Tennessee, ending claims that the company failed to properly care for residents in a range of ways. 

In her lawsuit against Linda Vista, Laurie claims that she visited her mother one day in April 2017 after Laurie’s brother had a disturbing phone call with Betty, during which she sounded incoherent. Laurie claims that she visited Laurie in person the same day, and found her drooling and soaked in her own urine.

According to Laurie, she asked licensed nurse David H. that Betty be taken to the hospital. Allegedly, David claimed that Betty’s state was not abnormal for her, and said that she did not need to go to the hospital. However, Laurie reportedly insisted that her mother be taken to an emergency room.

Laurie says that emergency room workers reportedly discovered that her brain was malfunctioning, despite David’s claims that Betty did not need to go to the hospital. Allegedly, the malfunction was caused because she had been given a dangerous dose of the opiate Norco.

Additionally, tests allegedly showed that the woman had not been given her two prescriptions — methadone and Ativan, her anti-anxiety medication.

Laurie claims that workers at the emergency room also found a number of disturbing evidences of neglect on Betty’s body. Allegedly, Betty’s bra was covered in black mold, her toenails had fungus on them, and she had pressure ulcers forming on her backside and back. She also allegedly had a yeast infection festering in the folds of her stomach.

Per nursing home records, Betty allegedly had not been given a bath for a week prior to the incident.

Despite these occurrences, Betty was reportedly sent back to Linda Vista once she was more stable. In Laurie’s nursing home lawsuit, she claimed that after the incident, Betty was not given her prescribed methadone for the 17 days leading up to her death.

Eight months later, David reportedly admitted to stealing medications from multiple residents of the nursing home residents, including Betty.

Kristi H., a spokesperson for Prestige Care, said the company took swift action to correct “medication diversion” and launched an internal investigation into the issue.

Sadly, Laurie’s nursing home lawsuit is not the only case of possible abuses that took place at Linda Vista. State records note that there have been other confirmed cases of abuse at the facility in which Betty was housed. These cases include failing to give prescribed medications, failing to make sure that a resident is safe, and failing to act in accordance with a resident’s rights.

In general, nursing home neglect lawsuits are filed individually by each plaintiff and are not class actions.
