Atrium Surgical Mesh MDL Overview: 

  • Who: Atrium has agreed to a confidential amount to resolve claims it sold defective surgical meshes. 
  • Why: Plaintiffs claimed Atrium misled doctors about the dangers of its C-QUR Mesh devices. 
  • Where: The MDL was heard in New Hampshire federal court. 

Atrium Medical Corp. has agreed to a settlement of an undisclosed amount that will resolve claims it sold defective surgical meshes that harmed consumers. 

Plaintiffs are now asking a federal judge in New Hampshire to set up a settlement fund so they can begin receiving payouts, according to a recently filed motion. 

The settlement agreement ends nearly five years of litigation between Atrium and plaintiffs who claim they were harmed by the company’s surgical meshes.Atrium continues to maintain its innocence of wrongdoing or liability as part of the terms of the settlement agreement, according to the motion.  

Plaintiffs have asked the judge to help set up the settlement fund since, as it currently stands, they say “the exact distribution of any settlement monies to the Plaintiffs cannot be finalized.” 

“The Parties, therefore, ask this Court to order the establishment of the Fund to facilitate resolution of those claims through collection, allocation, final disbursement, and accounting of settlement proceeds and to appoint a fund administrator in connection with these activities,” the motion states. 

Plaintiffs Have Questioned Whether Atrium Was Aware The Device Could Cause Allergic Reactions

Multidistrict litigation against Atrium launched back in 2016 after more than 1,000 claims the company misled doctors about the dangers of its hernia repairing C-QUR Mesh device, Law360 reports. 

Plaintiffs questioned whether Atrium was aware that the device could cause allergic reactions and if it contained a proper amount of warnings. 

Atrium’s contributions to the settlement fund will be restricted to providing the confidential amount agreed upon along with legally required data and forms, according to the motion. 

“Atrium shall have no responsibility for the expenses or administration of the Fund and shall have no liability to the Claimants in connection with such administration or decisions made by the Administrator in the discharge of any and all Administrators’ duties,” the motion states.

    I have waited in PAIN, Lost my job, and much more due to the HORRIBLE, INFERIOR, Atrium Pro-loop Hernia Mesh and plug used in me in 2010! Atrium must have the FDA in their back pocket, or front pocket! Nothing has been done. Atrium medical has even changed their name to try and get out of paying what they clearly knew was POISON!!!

    I received C Qur mesh in 2010..on disability because of it..tried to remove it in 2011 and 2012..due to my body rejected it. UNSUCCESSFUL!!! developed Ibs..irritable bowel syndrome. Recurrence of hiatel hernia.. chronic pain..if I bend over say to tie my shoe..when I sit up after bending over I literally have to push my guts back down to where they should go…if I don’t..SEVERE PAIN..I thought I was alone in this fight…glad to see I am not…now..if I can find a lawyer..no class action either..you receive a very small portion..I want to sue for up to $10 million…due to the fact..I have no quality of life at this point and every Dr and hospital just passes the buck to someone else so noone will help me..I’m about ready to just give up..I can’t live like this…I don’t know how anyone could

      Michelle…you are not alone! I thought it was just me as well glad to know somebody else knows exactly how I’m feeling …everything and I mean everything started with this mesh the infection and all that I went through can’t even begin with a dollar amount.. because this is how we live everyday..I do have an attorney already.. and I hope that by now you have a team going to bat for you by now.. May God bless you and keep you…

        No I do not Shay..and now have the operational notes proving C Qur mesh was used..I have to meet with a cardio..thoracic..surgeon..for the reoccurence of the hernia..and defective mesh..I desperately need help with this
