New Malignant Mesothelioma Lawsuit Filed Against CBSA new lawsuit has been filed against CBS Corporation and multiple other subsidiary or related defendants alleging asbestos exposure caused a former employee to develop malignant mesothelioma.

The plaintiff in the lawsuit says that the defendants recklessly exposed him to asbestos fibers that caused him to develop malignant mesothelioma over time.

The malignant mesothelioma lawsuit says that the plaintiff has suffered from this medical condition directly because of his work environments over the course of many years. The lawsuit says that the plaintiff was originally exposed to asbestos working for the U.S. Navy and in a shipyard. He says he was not warned about or given appropriate safety gear, but was regularly exposed to asbestos fibers that have now caused him to develop mesothelioma.

The lawsuit argues that due to his malignant mesothelioma diagnosis, the plaintiff has and will continue to suffer numerous problems like anxiety, emotional distress, physical impairment, loss of enjoyment of life, mental suffering, and physical pain.

The malignant mesothelioma lawsuit was also filed on behalf of his wife, who says that she has and will suffer harm such as loss of moral support, loss of love, loss of companionship, and more.

The lawsuit says that the defendants are responsible for design defects in products that allegedly fail the consumer expectations test. The lawsuit argues that because airborne asbestos was tied to the products that the plaintiff interacted with as a part of his job, he ultimately developed malignant mesothelioma.

The plaintiff also says that the companies named are responsible for failing to warn him since it was reasonably foreseeable that the asbestos-containing items would release the dangerous fibers into the air. Although mesothelioma has a long latency period, meaning that it develops many years after exposure, there is no cure and the pain associated with the condition can be severe.

The malignant mesothelioma lawsuit says that, although the defendants knew about the risks of asbestos fibers inside their products, they did not affix a warning label that would have given employees knowledge about the risks involved in handling or working near those products.

The defendants are accused of selling these products to numerous work sites, including those that employed the plaintiff, without providing a warning about the safety issues associated with asbestos-containing items. The lawsuit seeks damages associated with these allegedly wrongful acts that exposed the plaintiff to a dangerous work environment and asbestos fibers that caused him to be diagnosed with malignant mesothelioma.

A worker may be unlikely to realize the dangers of their work environment until decades later when they receive a diagnosis of malignant mesothelioma. Mesothelioma comes with many different symptoms but can cause regular pain and discomfort for the affected person.

The discovery that hazards in a working environment caused malignant mesothelioma can be a shocking discovery, especially as medical bills mount and as it becomes clear that the diagnosis is terminal. The loss of a loved one from mesothelioma is devastating, since much of the medical efforts will be targeted on minimizing pain as the person’s condition declines.
