Manufacturers dinged with lawsuit over Asbestos-Related DiseasesA number of manufacturers are facing serious liability allegations in a recent lawsuit alleging the claimant developed multiple asbestos-related diseases after working with products manufactured and produced by the companies.

Lamons Gasket Company and Union Oil Company of California are some of the companies named in the lawsuit.

The plaintiff claims that these companies allegedly manufactured or used products that induced the asbestos-related diseases the claimant developed.

Plaintiff Gregory L. says he worked in several different manufacturing employment positions, each of which allegedly caused him to face a higher risk of asbestos exposure.

According to the lawsuit, Gregory was diagnosed with asbestos lung cancer and asbestosis due to the exposure he regularly experienced on the job.

Both of Gregory’s diseases are only possible through regular exposure, according to the lawsuit. The fibers either become lodged in the stomach or lungs, the, after years of dormancy, the fibers can manifest and cause scarring significantly raises the chances of lung cancer.

It is important to note that asbestos lung cancer can take up to 35 years to develop to the point where patients experience symptoms, which often results in latent diagnoses and limited treatment options. Asbestosis is also a form of chronic lung disease, which is caused by asbestos fiber scarring.

Overview of Asbestos Exposure Allegations

Even though these asbestos-related diseases are devastating to consumers and employees, Gregory was allegedly not given proper disclosures from the companies and were allegedly not discussed on the products’ warning labels.

The employment periods in which Gregory was allegedly exposed to asbestos include, but are not limited to:

  • Ordnance Worker for the United States Navy from Nov. 20, 1967 to Feb. 19, 1968
  • Pipefitter for Tosco Oil Refinery in California in 1975 to 1979
  • Pipefitter for Cory Delta Incorporated at different locations from 1980 to 1982
  • Pipefitter for UCI Construction Company from 1982 to 1984
  • Pipefitter for Timec Company Inc. for nine months in 1986
  • Pipefitter at Bay-Western Industrial Maintenance Inc. from 1987 to 1988
  • Pipefitter at GSI of California from 1992 to 1994

During each of these time periods, Gregory says he was exposed to asbestos on a regular basis and had no way of protecting himself from the potential health hazards.

Gregory was ultimately diagnosed with chronic diseases in July 2009 and has been contending with them ever since. Gregory opted to file legal action against the manufacturing companies after discovering they either knew or should have known about the dangers surrounding asbestos exposure.

Asbestos is a well known fibrous material that was popularly used before the 1980s for its fire and chemical resistant qualities and was reportedly very cheap for manufacturers. This means asbestos was used in a wide variety of purposes including by the United States military during World War II.

The United States Navy frequently implemented asbestos for insulation purposes in its ships and naval yards. This caused numerous military veterans to be exposed during their active duty, along with many workmen who had installed the products.

It is important to note that veterans and manufacturing retirees are among the most at risk groups of developing asbestos-related diseases.
