Man alleges ExxonMobil Corporation contributed to Occupational MesotheliomaExxonMobil Corporation and several other companies are facing a new asbestos exposure lawsuit, alleging they allegedly failed to protect the claimant from occupational mesothelioma.

This asbestos exposure lawsuit was filed by a man from Louisiana, alleging his occupational mesothelioma was directly caused by the regular asbestos exposure he endured while working for ExxonMobil.

Plaintiff Edgar L. further alleges the products he worked with, which were manufactured by the other defendants named in this lawsuit, contributed to his occupational mesothelioma.

According to the asbestos exposure lawsuit, Edgar had worked as a warehouse man for ExxonMobil Oil Corporation Refinery in Baton Rouge, La., and reportedly experienced occupational asbestos exposure between the late 1940s and early 1950s.

During all times relevant, ExxonMobil allegedly failed to provide Edgar protective equipment or warned him that he could encounter potential occupational asbestos exposure.

Edgar alleges that as a direct result of this regular asbestos exposure, he was diagnosed with occupational mesothelioma, and currently contends with the disease. It is important to note that mesothelioma is a very rare respiratory cancer that is specifically caused by asbestos exposure.

In contrast to lung cancer, mesothelioma manifests in the lining around the lungs and is specifically caused by asbestos fibers becoming embedded and scarring the lining.

While asbestos is harmless when dormant, the fibrous material can become deadly once it is released into the air. Asbestos fibers can either be inhaled or swallowed directly, or can be transferred to other people with second hand exposure due to the fibers attaching onto the primary carrier’s clothing.

This means that not only are certain retirement groups in danger of occupational mesothelioma development, but their loved ones too.

Overview of Occupational Mesothelioma Problems

Asbestos
is a fibrous material that was commonly implemented for a wide range of industrial purposes in the manufacturing industry before the 1980s. Due to its fire and chemical resistant properties, it was very popular with the United States Navy and was used in ships and in naval yards for insulation piping.

However, this means a number of United States Navy and other military veterans may be a risk for an occupational mesothelioma diagnosis. Over 75 different occupations come with asbestos exposure risks, with auto mechanics, textile workers, construction workers, and firefighters the most at risk.

Mesothelioma is a very slow progressing disease, which can take up to 50 years to develop to the point where patients experience symptoms. This often results in late diagnoses and limited treatment options, which means shortened life expectancy.

Even though federal law requires manufacturers to provide clear disclosures and protective equipment to workers in case of occupational asbestos exposure, ExxonMobil and the other defendant companies allegedly failed to do this for Edgar.

Edgar was allegedly denied the ability to prevent himself, or at least decrease his chances, from developing occupational mesothelioma. This asbestos exposure lawsuit is seeking a multitude of damages against ExxonMobil and other companies, including negligence and failure to warn.

This Occupational Mesothelioma Lawsuit is Case No. 3:18-cv-01027-JWD-EWD, in the 19th Judicial Parish of East Baton Rouge, state of Louisiana.
